im hooked until she get Green card or dies or goes back home.

You obligation does not end unless:

  • She naturalizes
  • She is credited with 40 quarters of work
  • She surrenders the green card and returns to her country
  • death of one of the parties

Did you not see any red flags before or in this marriage? Would you like to share those with other VJ members? I am sorry to hear your situation, which is tragic, but it's important that you share your experience in detail, so people like these be weeded out in time. Thanks

Sorry sir but how could you be sure about anything by hearing only one of two parts involved in the problem?

If you'r Moroccan sir, I believe that Moroccans don't wait for their wives' money because we have the conviction that it's theirs and it's shameful for them to count on their woman's income. It's her money and she's the one who decide how to spend it

The only thing that you can be done is pray that your spouse is honest and as soon as their able to work make sure it's full time this I-864 is binding and if the person just ups and leaves there's really nothing you can do.

You can ask to withdraw your joint I-751 application because she filed for divorce. Send a letter with a copy of your I-751 receipt notice and copy of divorce papers and let them know you are no longer together and no longer wish to file jointly for her removal of conditions. Divorce does not negate the I-864, so you are on the hook for that even when divorced and even if she gets the 10 year card on her own by filing a divorce waiver for the I-751 after you ask that your joint form is withdrawn. This is stated clearly on page 8 of the I-864 form before the signature area.

This woman does not want to work she thinks i owe her the divorce is in court and she brings up the I864 but i only have but so much money if they take some of that she still has to work iam not rich. There some good people out their but i would never trust someone who had IMMIGRATION to gain by Marriage because once you sign that I864 they got you sad but true taking care of a healthy adult makes me sick.

After Greencard how long does it take for Citizenship?

She can file for citizenship 5 years after she became a permanent resident. She does not have to file for citizenship ever.

The I-134 is not binding but when your fiance arrives and you fle for AOS you will have to file the I-864 which is legally binding.

Ok question does this woman need me for anything dealing with Immigration? An will it be an interveiw?

Here is what you can do:

You can go to the local office of USCIS and let them know your story. (be honest).

You can send a letter to the service center you sent your papers to with the case number and alien number (you have to include those so they can find the file)

If she ask you for any immigration benefits don't do it now.

Regarding your I864:

Since you sponsored her: you are responsible to help her before the government.

you have to help her until (this is when the I864 is not valid anymore):

- she becomes a citizen

- she works for 10 years.

- she dies (God forbids)

- she is deported.

She can apply for citizenship once she turns 5 years from when she got the first green card.

Try to remove her name from anything that you both have (bank accounts, lease, utilities, insurance, cars...) She can use all of those to prove that she entered the marriage in good faith,

Having her deported is not your job it's USCIS job.

Right now my thoughts to you is just sit back and hope she doesn't good any government help because the government will come to you and tell you to pay back. I'm helping you not because I want your wife to be deported, but because she didn't respect her vows in front of God and she used you for a green card.

If i have to give her money it would be better from the Goverment than i can pay small amounts me and this woman married in the masjid i only done State marriage so she could stay here while Immigrtaion procees was going on. She knows when shes divorced ISLAMICLY if theres no kids she goes back to her famliy.
