Hello there.

Serious problem on my hands now...

I am an american citizen.

My sister and her husband are here in US on a small visit.

Although they have good jobs in their home country (public system), a car etc. i managed to convince them to immigrate in US.

To be honest, it was a spontaneous decission for all of us.

My question...they have a 10 year B2 visa for the US. Now, they can stay legally in US, with me of course, for about 6 months.

Can i apply for the I 130 and AOS for them (my sister and her husband), so they could remain here in US, instead of going to their home country?

I repeat, they have a car there, jobs etc. Nothing was sold, dumped, left behind etc.

You can sponsor your sister, but the waiting period for an immigrant visa for siblings of US citizens (F4) is at least 12 years right now, depending on where she's from. She will have to wait outside the US while it's processing.

siblings cannot apply for AOS, they must return home and wait for you to petition for your sister, who can then petition for her husband after she arrives.. As the previous poster stated, the wait time is about 12 years.

No you have to wait around 12 years for a visa number to be available and any overstay will make them ineligible for immigration. You came to this decision without knowing it is impossible.

Hello.

What do you mean by " soon will be eliminated " ?

Means exactly that you will not be able to petition for sisters and brothers soon. I believe they are looking at 2014.

Hello.

What do you mean by " soon will be eliminated " ?

If the new immigration law is passed, chances are there will be no longer a sibling category. You should apply for your sister immediately and she should return home and wait for her process to be approved and a visa be made available to her. There is no way she can do AOS while she is here.

Hello.

What do you mean by " soon will be eliminated " ?

according to the new immigration reform bill formulated by the 'gang of eight' senators significantly alters the immigration system and part of it is to eliminate the sibling category completely and instead will help siblings of USC's to get more 'points' for having a USC sibling in order to immigrate.

the bill is still in the congress and not finalized, its a comprehensive bill with whole lota changes..

What does that mean exactly? How will the points work? What if you have 2 siblings that are USC and you are single and the only one left in the family back in the home country?
