I'm going to the US in October to get married. Currently, I have a 10 year visitor visa for the US in my Malaysian passport which allows me to enter for 6 months at a time. I would like to stay with him until January, which is when he gets deployed. Then I intend on coming back to the UK and starting the visa process (I know he will have to file it before getting deployed).

My questions are:

A) Is there a special procedure I have to go to because he is in the marines? Like is there somewhere on base we submit our application to?

B) Will it take a bit quicker because he is in the marines?

C) When I go to the US in October and get married/stay for a few months, I will be using my Malaysian passport. That is also the passport I've used to visit him before. However, I feel like using my British passport might be better for visa application. Am I right in thinking this? If so, to make everything easier should I just travel only British passport when I go there?

Thank you so much for any help. I am so confused by all the forms and hearing some people say they need to send prroof of their relationship but I didn't see it anywhere on the form. We migh just hire a lawyer to submit everything for us. Not sure if it will be worth it though.

I do not believe there is a special place for military people to file. There is a way to apply to expedite yor case due to deployment. You might want to look into that and do it quite soon.

I'm sorry I'm not much help!

Good luck!!

B) Will it take a bit quicker if he is going to be deployed in February? Where would he put his request for expedition?

C) When I go to the US in October and get married/stay for a few months, I will be using my Malaysian passport. That is also the passport I've used to visit him before. However, I feel like using my British passport might be better for visa application. Am I right in thinking this? If so, to make everything easier should I just travel only British passport when I go there?

D) Should I apply for the spouse visa while in the US? After reading more about the expedition requests, it seems it helps if he is about to be deployed. In that case, we should apply befor the gets deployed but I don't know if I should be out of the US for him to start the application.

Thank you so much for any help. I am so confused by all the forms and hearing some people say they need to send prroof of their relationship but I didn't see it anywhere on the form. We might just hire a lawyer to submit everything for us. Not sure if it will be worth it though.

Regardless of wheather he is marine or not, you are required to file through USCIS just like everyone else. There is no way you can file on base, the only thing the military can provide you with is:

1) A lawyer if you request for one (My then fiance did and we got a lawyer via the military for free)

2) His deployment orders. It will be dvantageous for you to submit your application together with his deployment orders, with a letter attached requesting for expedite processing.

Good luck

Pardon me for the typo, i meant 'advantageous' . idea9dv.gif it happens!

With a copy of his orders you should be able to request your case to be expedited providing that you have already gotten married and filed the I-130. This link is a good place to start.

Check with his command. My husband is military as well and there is an immigration services office on base that helps with applications and all that. I never used it since I applied for ROC when we were in-between assignments but if he is assigned to the unit his COC (chain of command) can take him to the office and makes sure everything is filed correctly

08/2008- met in Baltimore. I was on J1. Started dating.
07/2009- I went back to England to finish my BA(Hons)
12/2009- he visits me in England and proposes on new years eve
04/2010- I visit him in Baltimore on B1/B2. We spontaneously get married. I leave to go back to England.
10/2010- he comes to meet my family in Russia. We have our "honey-week"
11/2010- I come to visit on B1/B2 again and he convinses me to stay
03/11/2011- sent out AOS
03/14/2011- package received
04/2011- RFE
05/2011- sent out response for RFE
07/08/2011- EAD card recieved
7/21/2011- Green Card interview success!

I am marrying a US marine on December. Just like everyone else, you have to file at USCIS and you will get the same timeframe. Unless he has orders to be deployed soon, if that is the case, you can have the petition expedited. We tried looking for someone in base to help us but most of them were clueless so we had to file the visa ourselves, which wasn't really that hard tbh. My fiance didn't have to ask his CO permission to marry a foreign national, contrary to what others say. However, a letter from his CO about his rank, pay, when his enlistment is up, and all other info was needed. We used 6 months of his most recent LES and 3 years worth of w2 for proof in affidavit of support. It doesn't matter if you use Malaysian or whatever other visa to see him. What matters to USCIS is that you physically met and have proof for it within the 2 years of you applying for the fiance visa. As proof of relationship, you will need to send them pictures, plane stubs, plane ticket copies, receipts, chat, call logs etc., of you two, to prove you have a bonafide relationship.
