I'm very glad I didn't withdraw this petition. WE JUST GOT APPROVED!! Yes!!! we made it through this step where no lawyers wanted even to take my money to give it a try. Just had God as my lawyer and surrender to his will.

We got RFE on October 24 asking for proof of meeting withing the two years, or explain why if we didn't. I explained why and the hardship I was while raisin our newborn with the limitation to find jobs. I also attached the letter in witch they approved the fee waiver for my Citizenship and some documents about my son being on speech therapy.

Soooo.... yes... Another "impossible" case was just APPROVED!! GOD ALMIGHTY APPROVED IT!!!!

It is rare to have a hardship waiver for the meeting exception approved, so extra congrats to you! star_smile.gif

8/9/14- Mailed I-485/131/765 (took a long time to get our Marriage Certificate)


8/15/14- notified via text and email that application was accepted on 8/12 and being processed.


9/8/14- Biometric done; 11/5/14- EAD/I-131 Approved/Card Production


11/5/14- AOS moved to testing/interview; 11/13/14- EAD/AP Combo card REC'D


12/16/14- AOS Interview- APPROVED! 1/3/15- Green card approved.

02/04/2014 After many months of waiting and frustration, FI finally got his birth certificate, passport and police clearance from his home country and we received an SMS today stating that his SA Police Clearance was finalized.

2/20/14- Second packet 3 sent to consulate


2/27/14 Followed up with Consulate to get interview date. They schedule an interview for 2/20 when he submitted the application of readiness (what we had to do to extend his NOA2) on 1/21, but they didn't notify us of that appointment, so we missed it.


3/27/14- Interview- APPROVED!!!


4/10/14- FI entered US via LAX and flew to SF 6/14/14- Civil Ceremony

Oh here is an update in case any new members are seeking for answers on impossible cases. My fiance has her VISA ON HAND and I'm going on a quick trip to go pick her up next week.

After the interview and other administrative process we were requested to file the I-601 and I-212 waivers. They were approved with no RFE.

THANKS GOD FOR THIS VICTORY AND THE OTHER ONES TO COME!

6/11/2010 - Our son Christopher was born
7/??/2010 - Wendy was cited to report in person at Tampa's Immigration Enforcement Office
1/20/2011 - Wendy left to Guatemala. our son stayed with me.

3/25/2013 - I became a U.S. Citizen
5/07/2013 - I-129F sent.
5/10/2013 - NOA1 received
8/22/2013 to 8/29/2013 - Visit for one week. Christopher stayed with mom.
10/24/2013 - RFE
11/25/2013 - NOA2 Approved!

01/31/2014 - INTERVIEW: Officer said everything was good, but gave us a 221g to submit a co-sponsor with form I-864

2/12/2014 - Was told to file Waivers

5/21/2014 - Waivers I-601 and I-212 filed

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

  • As of November 3, 2016 We received an email in regards to not receiving in the mail the Request for Evidence (RFE) , come to find out they really didn't need any additional information. So now the have to wait another 120 more days before we can get an interview or approval. This is some BS.
  • As of February 7, 2017, We received in the mail Interview Date for AOS on March 20, 2017
