Hi :

I have a situation right now and would like some advise.

My wife is a US citizen and she applied for me .

She was working full time and initially she filled up i-864 form for me for the affidavite of sponsor.

But recently she lost her job and I also think to bring a co sponsor is the best option for me .

So My wife friend is willing to sign the affidavit of support form and we are kind of stuck in few things.

In the i-864 form She will fill up

1d- I am the only joint sponsor

or

1e- I am the first or sencond joint sponsor.

Can she be the only joint sponsor now ( Our interview is very soon and my wife already filled a form before as i-864 form )

i-864 part 3 : I am sponsoring the principal imigrant

yes or no?

And the most important thing.My wife's friend in last 3 years tax return one of the year she filled jointly with her husband ( 2010) how to calculate that year ( From w2 form ?)

Your wife is the Petitioner. She is also your Sponsor.

Your friend's wife is the only Joint Sponsor. The rule is that a beneficiary can only have one Joint Sponsor.

You are the principal immigrant since your wife filed for you. So, the answer is yes - she is sponsoring the principal immigrant.

To calculate her income, you go by her W-2 and any income you can prove is hers. Her husband's income will not count.

If you want to use your friend's husband's income, he chooses to be a Household Member for his wife. She would be the Joint Sponsor filing an I-864 , and he would be her Household Member filing an I-864a.

I have few more question if its okay for you to answer because the new i-864 is kinda complicated.

  • I cannot put any dash on the form ... So lets say a address is 24-22 ...so if i put 24 22 is it fine ?
  • On the new form first page right side .Mailing address 2.a to 2h..whose mailing address should I put .
  • Other information (on first page ) Country of citizenship DOB and alien Number..whose info should I provide here..

First, I would suggest your spouse and your joint sponsor do the filling out of their own affidavits of support. They are far more likely to understand what is what and whom is whom. Questions are asked in the present tense, not past tense.

I have few question about the new i-864 form . If anyone can answer me that would be great

This is still part of the principal immigrant. If they do not have an alien number (which they likely will not) leave it blank

Thanks . One more small question . My Joint sponsor previously sponsored somebody else. They are still in process ( I mean she sponsored her family member who lives in back home and that will take a while ).but not a permanent resident. So in the household size number 6 there is a ques. if you have sponsored any other person i-864 who are now lawfully permanent residents enter the number here. So should I put any number or keep it blank, because the person she sponsored before is not lawfully permanent resident yet. Thanks

Only count LPR that the JS has a current I-864 obligation for. Since her family are not LPRs, then she doesn't count them.

Does your friend know that if she is the JS for your wife, she would need to count her when he files the I-864 for her family?

This happens every once in a while. It happen recently to another poster. He was a JS for his friend's wife. He made enough for a household of 2 but not 3. When it was his turn to file for his wife, he needed his own JS because he had to count himself, his wife, and his friend's wife that he has a current I-864 obligation for. If he was not a JS for his friend, he could have qualified on his own.
