The question is...... BY the end of the fiscal year? Which is September 30, 2013..... When I hear the word "BY" it means that it should have already started. SO ... to me, that means they should already be processing the cases at the new facility. Too bad we don't see any evidence of that. I wish they would get their act together. If they have to train people for this job, why aren't there still people working on the current workload?

It says "NBC anticipates beginning adjudication of the I-130 petitions in September 2013 at the Kansas facility."

USCIS tier 2 just (like an hour ago) told the petitioner they are working on I-130s at Overland Park and going through January cases right now. Seems like he was misinformed...

IR1 took 520 days....

We are overseas filers, and we're past the 90 day mark.

"NBC anticipates that Division 8 will begin to adjudicate stand-alone immediate relative Form I-130 petitions by the end of Fiscal Year 2013."

Our case was already sent to Overland Park, KS in May. Does this mean that the case will just gather dust in there until the end of fiscal year?

Even expedite requests are taking months where it used to be just a few days if not a few hours. Edited by onek

Response: The current processing time for stand-alone I-130s filed by an overseas petitioner is approximately 60 days from the date of receipt at NBC.

Is this the 'current' expectation or proposed expectations? It almost sounds as if this is the current processing time. As a May filer, I'm wondering if mine got lost in the shuffle as it is past 60 days.

Where did you get this information from? I filed from abroad and am at 5 months.

That is an excerpt from the NBC meeting, which is the topic of this discussion. See the first post for a link to the transcript. As for still waiting after 5 months, perhaps you can use this transcript to demonstrate that your case is not being processed correctly.

01/15/2014 - NVC Received (TSC held it for 3 weeks...)

02/19/2014 - Case no. and IIN assigned; requested embassy change

02/27/2014 - DS-261 available and submitted

03/27/2014 - AOS entered into system

03/24/2014 - New case no. assigned

03/25/2014 - IV fee invoiced and paid

That's exactly what I was looking for! I have a sheet to fill out to contact my congressman, and I'm glad I have something to site to show that mine is taking too long (for filing from abroad). Thank you!!

None of the processing times are written in stone... they are only estimates. There is no way to check the processing times for the NBC I-130's. That is not by accident. They know its a mess.

Contact your congressman, but you'll get the same form letter we all received stating a 12 month window. its worth a shot. I received a follow up email from the advocate who helped me with the inquiry. She said she can re-check my case every 30 days. I sent a reply thanking her and telling her I would appreciate that very much. There isn't much more I can do.

I'm going to see my dear husband this Saturday. I have given up hope for an approval while I'm visiting him. I just want to enjoy every minute with him. And I hope my sister-in-law delivers her baby while I'm there. She is due next week dancin5hr.gifdancin5hr.gifheart.gif

Yup, we have no illusions that contacting the congressman will somehow magically make things happen. But, it's pretty much the only thing we can do at this point. There's no way to schedule an infopass overseas and besides I don't think that would help much either.

Yeah I've been taking my time with the congressman. I wrote him a few weeks back and they told me to send in a release of info form, which I've had sitting around for 2 weeks now. I was just so sure I'd get a "wait 6-12 months" back so I wasn't in a rush to get stuff sent back in. But now that I have *proof* that petitions filed from abroad should only take 60 days to be approved, I'm sending in everything today. Including a copy of the transcript showing that NBC says it should only take 60 days.

Our congressman answered quite fast and we'll send the release form asap as well.

I understand that these things take a while, but I don't understand why they send cases to a place that isn't even open yet.

Hey Ellinora - I think we are in the same boat as you. We're also at Overland Park, we have PD of 7th June and I've checked out Case Status and the last time our case was touched was 11th June, sounds like we are just sitting in a big pile in a room and not even being looked at. I was hoping that because we're day 80 (today!) we might get some good news in the next week or so like some other overseas filers who are around this wait time but if we're all in Overland then we probably won't hear anything until after they open at the end of September. This is just the most frustrating process!
