K1 filing for AOS - Marriage Certificate

Good Morning,

I'm just preparing for the next step. We plan on getting married ASAP. My state requires we apply for the license, wait 3 days and then can pick up the license so we can get married. It takes about 30 days after marriage to get the certified copy in the mail. Now, I know the marriage certificate needs to be submitted as part of the application. My question is, if we submit with the license and file for AP and EAD with AOS, will this cause a delay with the issuance of the AP and EAD?

I know we would have a delay with the processing of AOS and should expect to receive an RFE for the marriage cert. I'm just exploring all possibilities. My fiance is cringing at the thought of having to wait 2-3 months for EAD after we file. So the sooner we file, the sooner he can get his EAD.... Just want to make sure our AP and EAD applications will be accepted without the certified Marriage cert.

I know it is a complication I am proposing and it sounds crazy. I just want to get some insight from those who have seen or have experienced it.

I will advice you wait patiently for the marriage cert to arrive...Its rather unfortunate cos south Carolina is just three days and u get the full liscence ready...The USCIS will not make any decision on your AOS,AP or EAD application if all reguired documents are not submitted...Dont even dream of recieveing an RFE before sending in the Liscence cos after you reply the RFE it can take months and months for USCIS to even touch your file and continue for process for you...So pls endure the one month wait and get your marriage liscence and send it in once and for all.....All the best in your Journey...God be with you

Don't wait a month! When you submit your license ask for certified copies immediately, you will probably have to pay around $7 per copy but they are signed, stamped and sealed by your county clerk. All you will get back in the mail in a month is the exact same thing, however yo will have waited a month to get it.

You cannot submit a license in lieu of a certificate.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

The amount of time it takes to get the certificate is county-specific, so investigate other counties around you to see if anyone can get the certified copy to you faster.

Good I will search around.

Also, be persistent. Remember the golden rule of immigration inquiry: not every govt worker knows everything, even if they seem to be giving you the absolute correct answer. If you call to find out that county clerk's procedure, they will often just give you the stock answer, "it takes 3-6 weeks" (or whatever). Make sure to ask the follow-up, "Is there ANY way to get it quicker--I need it for immigration purposes?" And even then, you may need to talk to a few different people there before you find someone who actually KNOWS.

True...very true. i will defintely use some persistence. Through this process you are your own advocate.

You may be able to get a copy of your marriage certificate sooner if you deliver your marriage license yourself to the court to be registered and/or go to the court to ask for a copy of the marriage certificate instead of waiting for them to mail you one.

I wonder if I could send an unofficial photocopy with my AOS package.

I will be getting married through a chapel agency and they could give me a unoficial photocopy?

I wonder if this could delay our AOS process?

No. It must be a copy of the marriage certificate you get back from the court once the marriage is registered.
