sent my i-130 february 15 ..

august 2 got a letter for RFE requesting my wife birth certificate and 2 passport photos of each.

i sent only one passport photo of each in the i130 packet didnt know they required 2

and her birth certificate i didnt sent because according to most here is not required just yet.

oh well im required to hand it over august 22 at my local INS office. ####### 3 weeks delay.

does anyone know how long after handing over RFEs will my case be accepted???

I'm surprised that they would RFE the beneficiary's BC at the USCIS stage.

As per the I-130 instructions, petitioners only need to send in 1 passport photo of petitioner and 1 of beneficiary, and they don't require the BC of the beneficiary (at this stage) ..

I don't know why you're saying birth certificate aren't required according to many people. It's amongst the most "initial evidence " that needs to be submit. Make a complete English translation if applicable and notarized. Whenever an RFE is issued it puts your application/petition on hold but it'll resume soon as they received it. Good luck!!

If you read the actual instructions to I-130 (http://www.uscis.gov/files/form/i-130instr.pdf) you will find that the beneficiary's birth certificate is not a required document.

Unfortunately, most local offices are using a dated manual and have been issuing RFE's for the beneficiary's birth certificate even though it is not required.

INS hasn't existed since 2003, it will be your local USCIS office that you will be going to (USCIS is one of the successor agencies, ICE is the other).

I got RFE'd at a local office for the beneficiary's birth certificate. It sounds like a common thing for whatever reason.

Should i be concern it seem you live in CA SAN DIEGO.. i live near there... that's not cool... they should have that updated.

If it is needed it doesn't need to be notarized. Notary's verify signatures not the content of a document.

The certification of a translated doc is simply a statement by a person fluent in both languages that they translated the doc.

Well guys.. Tomorrow im hand delivering(RFE) my wife birth certificate (copy and original) i will ask if a copy is good enough.. Don't t wanna give them the original since ill need it for DS230.
