Good friends I'm new and I need help with something ....



I came to the United States in June of 2012 with k1 visa, got married in July 27 I mean before 90 days and asking me to marry the person that had to do ...... I have my copy of marriage certificate and everything then what happens, I could not send the request for residency and I was doing pretty bad so I decided to go back to my country Dominican Republic on March 15, 2013 without making the process of residence ., when I pay the visa petition for permission to work and I get this when I get home to USA



When I return to my country and my visa had expired, valid only had my social security but decided to leave USA ....

Before leaving the center called U.S. immigration issues and only person we met said that if he left without making the process so there was no problem because I married the person I asked and within time I got, that if residence wanted to have had to start the whole process from my country and would not have any problem if I wanted was to apply for a tourist visa ...



The marriage he had with the person who asked me faded away, I'm in the process of divorce is people now ...



Then I want to know if I can divorce when you leave go to the consulate and apply for a tourist visa without problems I deny it because they saw that I did not want to stay in USA and I just want to go visit my son ...

I am having a very hard time understanding your story. So,

1. you came to america on a fiance visa and married BUT

you never adjusted your status because of marriage problems

you went back home and now are getting a divorce

you want to divorce but

you want to come back to usa to visit your kid

I think you will be denied a tourist visa because you will always have intent to stay in usa because a kid in usa is a strong tie to usa and nothing to stay in your home country

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

I do not think they think I will be for my son because I live beyond and I left ....

I think I'll have to wait for the divorce and go to a lawyer!

It's not the divorce that raises a red flag when you apply for a tourist visa. It's the fact that you have/had prior intentions to immigrate and with that on your record I'm afraid it will be nearly impossible to get approved for a tourist visa.

You can try apply for a tourist visa again, but you need to show extremely good ties to home. Having your not-yet-divorced husband and son in the US looks like you are trying to illegally immigrate to the officer, particularly because you DID have immigrant intent before with the K1. You need to prove you're not more strongly. You have a very hard case to prove.

Consider it from their point of view? You wanted to immigrate before. What hard evidence do you have now to show you don't?

All you can do is try. The odds are against you, but you'll never know until you actually apply for a tourist visa.

No harm in trying for a B Visa, can not work oput if you hjave a 3 year ban or not for overstaying more than 6 months past your 90 days, that would complicate matters.
