So, I'm having to get a joint sponsor and we're working on filling out the forms now. I'm in the Philippines now and plan on DCF filing so we have to get this right first time to save on shipping charges.

1. We both fill out his form http://www.uscis.gov/files/form/i-864.pdf

correct?

2. My aunt, the sponsor, selects 1.d * as she is the only sponsor) and I select the I am the petitioner.

correct?

3. When I fill the form out I will use my international address and not my us address?

correct?

4. I'm filing for my wife and her son.. so the part 2 and 3 kind of confuse me...

My aunt and I will fill in the principal immigrant info and then in Part 3 what should we select?

2?

I'm guessing we select 2 since we are petitioning my wife and her son.

5. Do I need to make sure to fill in everything with info..including n/a's and none's?

For the rest of the document do I also consider myself a sponsor? Silly question I know.

I don't want this to get moved to DCF because the activity seems lower, but when will I need the I-864 info when DCF filing? interview or when I got o embassy to submit the papers?

Start by carefully studying the I-864 instructions. Many of your questions will be answered there. You and your Aunt, the "only joint sponsor" will each complete one affidavit for your wife and one for your son. Do not mention either on the other's affidavit except to count the son as a child on your wife's affidavit and your wife on your son's affidavit. Note that neither your wife or your son will be listed as wife or son on their own affidavit BECAUSE they are already counted as the intending immigrant on their own affidavit.

See the instruction on the form itself that clearly states not to count anybody twice or in the upper section to list anybody for whom a separate petition was filed.

Will you be living with the joint sponsor on entering the US? If yes, then she has to fill out the I-864A. If not, then she has to fill out the I864 (the form you have given a link to)

In part 3, you tick Yes in reply to question 1 and then tick 2. Then under Family Member 1, you write your son's details

Yes you should add N/As and nones to questions with no answers. Though i don't think they will do anything if you don't either.

You are a sponsor as you are the petitioner. I'm not sure I understand this

It varies from embassy to embassy. So, it would depend on the instructions that your embassy gives you (i.e. if/when you receive packet 3/packet4). You do not have to take the I-864 when filing the I130.

Yes..I will be living with her when entering the US. I will make sure to send her the A version.

I'm not working and I haven't worked for a couple of years now. Which is why I need a sponsor. It looks like I will be putting a lot of zero's or nones on the form.

So, I will have 4 forms when going to the embassy, correct? I fill out one for my wife and one for her son, and my aunt does the same.

Since I am living with her..does she need to count me as apart of the household like my wife and her son? I assume yes, and that will be more clear on the A version of the form.

Actually, even if you were working, chances are that you would need a joint sponsor. Both my husband and I have good jobs here, but we still needed a joint sponsor, so that's cool.

Also, you should file back taxes (1040 + 2555EZ) as soon as possible, as that would help when you submit your I864.

From what you have written, it looks like you have not filed your I 130 petition yes, is that right? If so, then you will have to take just the I 130 for your wife and son (and preferably bring both of them with you) and the relevant proof for that, to the USCIS office in Manila. As far as I know, the petition has to be filed in person at the US Embassy in Manila. (you can check out the link here )

The I864 will have to be submitted later, or maybe brought to the interview (we brought ours to the interview), depending on what they ask.

Actually it works the other way around. As you are the principle sponsor, you will be counting her as part of your household.

This is incorrect. Only if they technically qualify as the Aunt's "household members" is it even possible for the aunt to submit an I-864. The aunt must submit two I-864 forms, one for each intending immigrant.

Incorrect. Select 1 and yes. In your case there are two petitions so two I-864. I already answered this question. Don't list anybody that has their own separate petition. Read the instructions right on the form itself, in that section.

It varies from embassy to embassy. So, it would depend on the instructions that your embassy gives you (i.e. if/when you receive packet 3/packet4). You do not have to take the I-864 when filing the I130.

No, Janini was not helpful. Janini misled you with false information. Read and follow the instructions I gave. They come from the form instructions I encouraged you to carefully study and work EVERY time they are followed.

Incorrect. Read the I-864 instructions as to who qualifies as a household member. Auntie doesn't. Rule of thumb in all joint sponsor situations is the head of household files an I-864.

I will be reading over the instructions on the I-864 form and working on it. I have to get the forms done because I need my birth certificate for the I-130 petition (right?) and I don't want to make my aunt to send papers here multiple times..since she is already doing a lot to help.

What is the I-864A form used for exactly?

how much is the filing fee for the I-864? per person? Would I be filing x1, x2 or x4?

I'm sure I will have more questions when I start going through and filling it out more thoroughly. I went and did my taxes last night online for 2012. I didn't make any money, but I want to make the form easy to fill out.

Please ACTUALLY carefully study the I-864 instructions, where many of the questions are answered. The I-864a is used by a household member when COMBINING INCOME. Auntie is not a household member AND you are not combining income.

I-864 fee is 0 when filing DCF.
