A friend of mine has been married for 3 years and he wants to file for adjustment of status but is not sure if his wife is going to cooperate and sign the required documents. They have had marital problems over the last year but entered into the marriage in good faith. Can he proceed without her consent? Thanks.

Timeline:

9-18-2010 - Sent AOS to Chicago lockbox

9-20-2010 - Package arrived confirmation USPS

9-24-2010 - Received txt message and email for I-797

9-27-2010 - Received NOA1 for I-131, I-130, I-765 and I-485

9-27-2010 - Checks cashed

10-4-2010 - Received biometric appt. (10-28-10)

10-15-2010 - Touched

10-20-2010 - RFE Notice Sent via email on I-485 (Bummer)

10-25-2010 - Recevied RFE

10-26-2010 - Send evidence

10-27-2010 - Evidenced signed for in response to RFE

10-28-2010 - Appear for Biometrics

10-28-2010 - I-765 & I-485 touched

10-29-2010 - I-765 & I-485 touched again

11-1-10 - rec.email regarding continued processing of I-485

11-12-2010 - Received call from congresswoman's office stating they were contacting USCIS to expedite EAD

11-15-210 - Received call from congresswoman's office confirming request to expedite approved and EAD will be adjudicated in 7 business days and should received card 10 days after that. Also the I-485 has been moved to the next step to schedule interview too. Yeah - so happy!!!

11-19-2010 - Received email AP approved and EAD card in production.

11-19-2010 - Received interview letter - appt scheduled on 12-21-2010. :)

11-22-2010 - Received AP in mail

11-26-2010 - Received EAD in mail (Went on 11-29-10 for job interview and start on 12-6-10)

12-21-2010 - Went on Interview and was APPROVED!!!

Unless he is being abused and therefore may be eligible under the Violence Against Women Act, no.

Spousal abuse is not a joke.

Nooooo its not funny. Its not even like that. Its a male that would b filing for aos n he would file under tha violence against women act according to tha response that was given. Imagine that

AOS based on marriage requires the spouse's signature. AOS also involves the I-864, whereby the US citizen spouse basically signs a contract to financially support the non-citizen spouse until naturalization.

Marital problems don't make your friend's application look good.

Adjustment of Status from H-1B, Family-Based
07/26/2012 - 10/18/2012: 85 Days from Application Received to GC Received.
Removal of Conditions
07/22/2014 - 11/14/2014: 116 Days from Application Received to GC Received.
Naturalization
02/03/2016 - 05/31/2016 : 119 Days from Application Received to Oath Ceremony.

I am a United States citizen!

10/10/2012 - Arrived to the US on M-1 Visa

01/13/2013 - Husband arrives to the US

03/15/2013 - Got married in NYC City Hall!Received marriage license on the same day.

03/30/2013 (Day 0) - Sent in I-130, I-485, I-765 and I-131

04/03/2013 (Day 4) - Package received in Chicago

04/10/2013 (Day 11) - NOA 1 text(s) and emails received.

04/15/2013 (Day 16) - Biometrics appointment letter for the 7th of May 2013.

04/22/2013 (Day 23) - Successful Biometrics walkin Varick Street, NY

04/30/2013 (Day 31) - I-485 case status updated to testing and interviewing. Still no updates on EAD or AP

05/07/2013 (Day 38) - Biometrics appointment

06/07/2013 (Day 69) - EAD updated to Card production. AP updated to Post Decision Activity.

06/15/2013 (Day 77) Recieved EAD/AP combo card

07/10/2013 (Day 102) Received first interview appointment
08/10/2013 (Day 132) Interview (which we rescheduled because I was out of the country at the time of the interview)

08/24/2013 (Day 146) Notification that our interview has been successfully rescheduled

11/25/2013 (Day 239) New Interview date: 16th of December 2013

12/16/2013 (Day 260) INTERVIEW! - Approved on the spot, will have green card within a few months
