My case, need help

I am the beneficiary

We met online through a game in December 2010.

We started dating in Feb 2011. I travel to U.S in Aug 2012 and live with him till Jan 2013 (6 months)

I have a couple of family dinner with him like thanksgiving, christmas and stuff but we only ever take 1 photo!! Didn't think photos are all that important as long as we are together.

We got engaged through phone calls in Feb 2013 shortly after I left U.S.

I am back in my home country to continue schooling and now we decided that I move to U.S. and live with him.

A few problems with us:

- My fiance is working a cash job. His pay is not trackable and he doesn't file taxes. He has a child support. His son doesnt stay with him but he owes child support like $20k. How are we going to do our I-134 Affidavit of Support?

- We only ever took 1 picture when we are living together for 6 months. How do I proof our relationship?

- What are our chances?

I worry day and night about this and I am still holding onto our I-129F forms and haven't started filing yet. We are planning to get married next year once my visa gets approved.

Can our fellow VJ-er help me with my case or anyone that has the same case with me?

1. Sounds like you're going to need a co-sponsor. Someone like one of his parents, for example, can co-sponsor. It's basically someone else that is willing to sign on the dotted line on his and your behalf to say that they will be financially responsible for you. Here's the info on sponsorship: http://travel.state.gov/visa/immigrants/info/info_3183.html (must be american, resident and earn above the poverty guidelines, basically)

2. Photos are only one way. You can also use the stamps in your passport to show you travelled together, receipts for gifts, chat logs, call logs, and you can have family and friends write letters to attest to your relationship.

3. Not bad. I think your main issue is likely your co-sponsor. Think about who you might ask for that. Next, take a look at other people in the same part of the world as you and see how they faired in their interviews - that's where the most variance and risk comes in since embassies can be harder or not than others. http://www.visajourney.com/reviews/index.php?cnty=Malaysia

Thank you for your reply and help. I really appreciate it.

What I have for my on going relationship and meeting within 2 years are, my airline tickets printed directly from emails, my other half of air ticket which I only kept the return I have that scanned and printed. I probably threw away the going to U.S. but I have one picture of them on my phone - I have that printed out instead from my phone photo.

I printed out 11 skype chat via window snipping tools showing the time of our calls, each calls are probably around 2-4hours. I have lots of it but I only printed 11 of it. I printed our profile to show that it is us since that our skype name is something else. Skype profile with the picture of us. Not sure how else would I proof that skype is ours.

I have passport stamps and I am going to attach the ONLY photo we have color printed from the photo store.

I am trying to front load them. Is that enough?

t is the USC that must send the forms in, You meet the basic requirements of proof of meeting but you are a but thin on relationship evidence. You can file and build a solid ongoing evidence set that should be ok for the interview

This will not be over quickly. You will not enjoy this.

I am going to send the forms that I filled and signed to my fiancé.

We won't be meeting in person anymore due to my schooling and probably will be denied a b2 visa and as for my fiancé, he doesn't have a passport due to child support.

Have any suggestion how else I could provide more documents to impress the consular?

You don't mention it so I'd just like to make sure: were you legally in the USA for the whole 6 months? What kind of visa did you enter on? You may have been fine, that just seems like a very long visit unless you had some sort of extended visa to stay on. And of course if you did overstay your visa, that will complicate matters. Just want to verify that!

Other posters' advice about not needing too many photos and relying on hard evidence like passport stamps and credit card receipts, ATM withdrawals, any third-party documents that show you were in the USA at that time -- those are the most important.

You don't mention it so I'd just like to make sure: were you legally in the USA for the whole 6 months? What kind of visa did you enter on? I am legally on b2 visa for 6 months. Visa stamp shows expiring on 2nd feb and I left on 31st jan. will that be an issue for me?

I have passport stamps and tickets to proof only. I cancelled my credit card and no longer able to access my e statement. There's no withdrawal from bank since my fiancé fund my living and I have been staying in his apartment. Just the 2 of us.

How can I proof anything at all?

Was the manager of your fiance's apartment aware you were staying there (did you sign a lease or get added to any forms)? Perhaps they could get a letter attesting to the fact that you were there. But mostly your passport stamps and airline ticket stubs should be enough!

He did not tell the apartment owner probably because I am there only for vacation not residing. I was suppose to be there only for a month and then return to my job but I got laid off right before my trip. So, I change my airline ticket and live there for 6 months instead.

Family and friends can proof that we are living together and have been dating. What kind of letter do they need to provide to support or is that not necessary?

I know our picture together isn't enough and we won't be seeing each other anymore. I am really worry we might not get through with just one photo. We weren't planning on getting k1 till recently and who would keep all those receipt if wasn't planning on doing something with it.

Why would photo be important if we see each other everyday, so didn't take much photo

I think the relationship evidence is the least of your troubles. Even if you have a co-sponsor, the USC petitioner is going to need to file his back taxes. A co-sponsor does not get him out of not legally paying his taxes. For the I-134 for the K-1, he will need to show his most recent tax transcript, letter from employer and/or most recent pay stubs. There has to be proof of his income. Even if he could get away with not having to show his taxes with the I-134(but most consulates still require them), when you get married and file for AOS, he has to fill out the I-864. He will need to show his tax info for the last 3 years or provide a statement as to why he was not legally obligated to file. Using a joint sponsor will not help this aspect. He must file the taxes he owes, or you will not be able to go through the immigration process, sorry.

I'm not trying to be a downer and, admittedly, I know very little about your situation but think about this sentence you wrote. Is this who you want to move half way around the world for? I know it sounds harsh but I hope your family is asking you these questions and you're asking your fiance, as well.

He works for cash, which means no benefits like health care insurance. (and he probably works for cash to avoid his child support obligation and, perhaps, his tax obligations) He pays no state or federal income taxes and no social security. He has a child that he's not providing for. He owes $20k in back child support...so if he ever does get a job with benefits and a paycheck, his wages will be garnished. He's unable to obtain a passport.

He's supposed to be able to provide for you when you move here. Maybe one day he will have all those things in order but he clearly does not right now. If he can't provide for his child, how will he provide for you? Have you asked him how he plans to do this?

Been thinking about this a long time myself but I truly just love him for his character.

I will be working once I graduate. I worked before continue schooling and get paid $20k a year without finishing my degree.

What do you suggest for us to do now?

Wouldn't the 20K child support or no passport send out red flags? I haven't heard anyone getting denied for past child support, but it would seem that this would be a huge issue. I'm not saying this to discourage, but I thought the interviewee has to determine if the fiance would become a public charge? This would run right into that.....I could be wrong, but maybe someone with more experience can elaborate?

But I do wish you the very best of luck.....these things can be stressful!
