This post is on behalf of friend while filling CR1 for her wife from Pakistan. This post doesn't address to my case.

"I’m getting married in Pakistan over the summer and going to apply my wife for immigration through CR-1 (Spouse Visa). This is going to be a first cousin marriage which is legal in the country of Pakistan. However, Illinois my resident state Prohibits First Cousin marriages with exceptions: 1. Age 50 or over; or 2. Sterile. And was wondering if this would get my spouse her visa denied.

Remember this is an arranged marriage between our parents; she is my mom’s elder brother daughter. What are the solutions? I’m a US. Citizen for last 20 years.

02/20/2013: Received Biometric Appointment letter (Day 12)
03/15/2013: Completed Biometrics (Day 36)
03/21/2013: Status Updated to Testing and Interview (Day 42)
04/01/2013: Received an Email as notice for Interview scheduled for "8th May".
04/02/2013: Received the hard copy of notice for Interview scheduled for "8th May".

05/08/2013: Interview done, Approved "Alham'Dullilah".

05/08/2013: Email notification for card production and approval of Green Card.

05/13/2013: Received Welcome to USA letter in mail.

05/16/2013: Green Card Received.

04/11/2013: EAD's status changed to "Card Production" notified via an e-mail.
04/11/2013: AP's status changed to Post Decision Activity (Approved) notified via an e-mail.
04/16/2013: Second email notification regarding the production of EAD Card.
04/18/2013: EAD has been mailed to my address. Notified via an e-mail.
04/18/2013: Tracking number for the shipment including EAD received via an e-mail.
04/20/2013: Received EAD Combo Card.

easy peasy - move to a state in USA where it's legal,

then marry

then file the I-130.

As long as your friend lives in a state that prohibits first cousin marriage, the US Embassy will apply the law of that state in issuing the visa - which means no visa.

Your friend must move to a state that allows its citizens to marry a first cousin in order for the US Embassy to issue a visa.

It's that simple. There is no way around state law. Move to a state that allows first cousin marriages and get the immigration visa. Continue to live in a state that prohibits first cousin marriages, then his wife can never get an immigration visa.

I think it depends on the laws of the state that you live in. Some states that don't allow cousin marriages will not void cousin marriages performed in states or countries where it was legal, but some states will void them. If you search cousin marriage laws on wikipedia it will list the laws for each state and how they handle out of state marriages

Hey bro. now I don't know where this problem actually rised from...

but I married my 1st cousin from Pakistan applied CR-1 visa while I was living in Illinois and she was in Pakistan

all good mate...visa approved in first go without any AP or sumthing...

so chill...go for it.. don't stress on non issues

This is misleading.

No state will void a first cousin marriage that wa performed in a jurisdiction where it was legal.

For example: first cousin marriages are legal in California and prohibited in Texas. A first cousin marriage performed in California is NOT voided when the couple moves to Texas.
