My Fiancee arrived in late February and we were married in early March. After a few delays I filed the Adjustment of Status which they received in early April. On April 11th they sent us a notice telling us we were to appear at the local USCIS office on May 2nd. (Her K-1 visa expires on 5/13)

I am just posting to ask what we should expect at this appointment. What kind of questions will they ask? Will they schedule her Biometric exam at this appointment? I assume we should bring previous documents and notifications with us.

Grateful for any information or advice that any of you should care to send my way.

Are you sure this is not your Biometrics appointment? Check your letter. Biometrics is always before the actual interview.

Yes, it is the Biometrics. This is only mentioned in passing, in fine print, at the bottom in a section about limited lobby seating so I missed it. Thanks.

Okay, what do we expect from that?

And typically how long after the biometric appointment do they schedule the interview?

They take a photo and fingerprints. Takes 10-15 minutes.

Not everyone adjusting from a K-1 gets an interview. Your case will either stay at the NBC and be processed without interview, or be sent to your local office and you will get an interview letter in the mail at that time. Currently AOS is taking quite a few months.

Does the fact that her K-1 visa expires on May 13th present any problems?

Her K-1 visa expired the moment she went through immigration at the point of entry into the U.S. It's her I-94 she received at the POE that expires on May 13. However, it's not a problem. The letter the USCIS sent her when she filed to adjust her status allows her to continue to remain legally in the U.S.

Your case is already at your local USCIS field office. Depending on how busy they are, you should have your interview within a couple/few months after the biometrics. The interview questions are routine. Bring along proof of an intermingled life.

Her K-1 visa expired the day she used it. If you mean that her I-94 expires on May 13th, it is irrelevant. She filed for AOS so she is now in a new period of authorized stay until a decision is made on her case.

How do you know their case will be sent to their local office for interview? This is just biometrics. Not all cases adjusting from a K1 have an interview. It is about a 50/50 chance.

A lot of people are approved without an interview. We happened to be called in for an interview, and it was pretty standard. We brought evidence of joint bank accounts, utility bills in both names, mail with both of our names, DL with the same address, pictures. Basically, I brought copies of anything that could show we have joined our lives and finances. The interview was fast and easy. We had only been married 3 months, so they weren't expecting tons of evidence. When we were going through AOS those with interviews were approved faster than those without, so it could be a blessing if you end up needing to go. Good luck with the rest of your process!

Do all AOS cases go through biometrics? I thought the only cases that went through biometrics were the ones which were going through the local field office, and if a case was going through the local field office an interview was a certainty.

Sometimes the biometrics location is not even the same as the local USCIS field office.

A long wait is usually an indication that a case is interview-waived and is still at NBC. If it's not, NBC transfers the case to the local USCIS office and the interview is usually scheduled quickly.
