Hi,

we just got our file approved and need to take the steps for the foreign embassy and also provide the affidavit of support.

Before, we assumed we would have a friend being able to help us, but they are worried they might be legally binded and get in trouble in case sth major happens like if i get sick or sth.

In general we have enough money, he has two student jobs (one of the jobs gives him free apartment including utilities). We also have some money saved, a car that could be sold and I might get a graduate assistantship for my graduate school. If the graduate assistantship doesn't work, we were planning for me to stay in US until next Spring when he graduates and then move to Germany where I am from (in Germany the government assists you in a lot of different ways). The problem is just that we dont want to be apart for another whole year...it is very very frustrating as you can understand.

PLEASE let me know if there is anything else that can be done to convince them that we can take care of ourselves. I feel very desperate right now and cannot think of any solutions and don't know who to ask for co-sponsor..we don't really know anyone who would feel comfortable for doing such a legal thing.

If you do not meet the minimum income requirements and cannot get a joint sponsor, there is nothing you can do to "convince" them to make an exception. If they made an exception for you, they would have to do it for anyone. The only other solution is for you to move to your spouses country, or get a full time job so you can meet the requirements of the affidavit of support.

How long can you stay on your visa? Any way for him to speed up his studies? Complete his studies in Germany?

12/19/13 - Transferred to Nebraska Service Center

03/18/14 - NVC Received file from USCIS

04/28/14 - Received/Paid AOS Bill

05/01/14 - Received/Paid IV Bill

05/14/14 - Sent AOS Package

05/30/14 - Sent IV Package

06/05/14 - Submitted DS-260

06/19/14 - Received checklist for AOS, resubmitted required corrections

08/09/14 - Case completed at NVC

08/14/14 - Received Interview Date

09/08/14 - Interview date - Approved!

09/11/14 - Raced into town, threw car into a parking spot, and ran down city streets to get to the courier company 2 minutes before the close to get passport back

10/10/14 - POE Entry

why not delay doc intake at NVC so that the USCitizen socked away more assets?

You have a year per thing, and there are two things (IV, AOS) to handle there.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

I was just on a J1 visa for 8 months and came back to Europe to finish my last semester here. So I will be done in a couple months and then we wanted to be together..unfortunately he will not be able to graduate this Summer..it is all very complicated.

If I was to find a job in the U.S., would it work then? But don't I need to get the permission to work first?

You can't work if you don't have employment authorization or green card. You can't get get a green card without the affidavit of support. So either he needs to find a job which will pay enough to meet the poverty guidelines or you need to find a co-sponsor. Unfortunately, these are the only two options...

On the other hand, it is unlikely your sponsoring friend will be asked to provide for you if you get sick or lose your job, unless you go on government benefits as a result. Even then it is not always done, and if it is done, it is not "getting in trouble". Emergencies happen. You and your husband can go ahead and use your qualifying friend as the sponsor, if you need to, so long as the friend agrees.

thanks..it has been very stressful and we cannot find a co-sponsor willing to do it and other people we know are not eligible...

we decided for him to move to germany, it is not ideal and still a lot of things to take care of..but anything is better than being apart.
