Hello,

I am a green card holder and my US citizenship is in process. I recently gave my Citizenship interview few days ago and it has been approved. Currently, I am waiting for the letter for my Oath date to get my citizenship certificate.

At the same time, I have been looking to file for my spouse immigration based on my US citizenship. One of the requirements to prove that I am a US citizen; to have the Citizenship certificate (which I still have to get from the oath ceremony).

I was wondering if i can file my spouse immigration on the USCIS approval letter and also attach a copy my green card. Once I get my citizenship certificate in a month or so, I will submit the citizenship certificate to USCIS as well.

I am basically looking to save time instead of waiting for the citizenship certificate and then file the paperwork for my spouse. I guess my question from VJ members; if USCIS will consider my application on the basis of a US Citizen if I attach citizenship approval letter (issued by USCIS officer at the interview) and green card (with a cover letter explaining that I am waiting for the oath ceremony) ? I can send the citizenship certificate once I get it. I want USCIS to process my spouse immigration on the basis of a US citizen, not as a permanent resident.

If any one can share their experience, please let me know.

The requirements are quite clear:

If you are a U.S. citizen, you must demonstrate your status with:

A copy of your valid U.S. passport OR

A copy of your U.S. birth certificate OR

A copy of Consular Report of Birth Abroad OR

A copy of your naturalization certificate OR

A copy of your certificate of citizenship

You'll probably get an RFE for lacking documents. Either way, your i-130 will not be processed until you submit your Naturalization Certificate.

You can file now as a GC Holder and upgrade when you have Citizenship.

Hardly seems worthwhile however.

Agree with Boiler. You should have filed a long time ago. There was no reason to wait for your citizenship (unless you just married recently or something), because permanent residents can petition for spouse, just with a long wait. Then, you could have upgraded if you got citizenship before it was current. At this point though, you might as well wait till you get citizenship.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
