Timeline

Got the unofficial word today that my wife's visa has been denied. :help: I had contacted my Congressmen about our case about a month ago. His aid called today and told me received a email from the Kyiv embassy saying we had been denied. The aid said he would email them back and try to get more info.(Nice guy). I hope to learn more when I get the packet back. All new ground to me. Any help would be welcome.:( Phil

USCIS:

03/29/2012 - I-130 Sent

04/1/2012 - NOA1 Received

06/25/2012 - NOA2 Received (88 Days)

NVC:

07/31/2012 - Case arrived at NVC (36 Days from USCIS to NVC)

08/16/2012 - Received case #, IIN, gave e-mail addresses

08/18/2012 - E-mailed DS-3032

08/23/2012 - AOS bill invoiced & PAID

08/27/2012 - AOS bill appears as PAID

08/24/2012 - AOS Package sent

08/XX/2012 - AOS/I-864 accepted

08/23/2012 - DS-3032 accepted

08/28/2012 - IV bill invoiced & PAID

08/30/2012 - IV bill appears as PAID

08/28/2012 - IV Package sent

09/07/2012 - REF Forgot bar code cover sheet in AOS packet

09/08/2012 - Mailed REF will be there Monday Sept.10th

09/25/2012 - Case Complete

10/30/2012 - Medical in Kyiv....All good

11/27/2012 - Interview date

01/15/2013- Call from Emb####

02/20/2013 -Denied

04/18/2013- Application sent to State Department.

08/23/2013- Talked to USCIS the application is back at USCIS and "might" review it by December.....

08/23/2013- Pissed off.

03/14/2014- Recivied notice from USCIS. Reply due 04/16/14

04/12/2014- Reply mailed 300+ pages.

04/23/2014- Reply from USCIS they received the packet.

07/07/2014- Called my Congressman to check on progress.

07/08/2014- Got a call back from Congressman aid "USCIS is working on it".

07/09/2014- Got email from USCIS that my address change had gone through. I never requested an address change. Call Congressman and USCIS. Was an error an no address change...

07/10/2014- Received email from USCIS. We are approved again. I think the call to my Congressman helped.

08/04/2014- Application received from USCIS and forwarded to Kyiv.

08/19/2014- Interview Sept.19,2014

09/19/2014- Interview Approved.

phil sorry hear this as I remembered we was in ap about same time frame keep us posted as to reason. fyi had sveta not receive her visa I was ready to ship my life to ukraine to be with her. since I had done this research if you choose this path let me know in anycase I am sure you will protest it

Not enough info Phil. Is this a "We are sending this back to USCIS denial" or is it a "221g denial" which means they need further information?

If it is a "We sent this back to USCIS denial" then you will need to learn the specific reason it was denied, correct the reason (if possible) and re-file the petition, with a waiver if necessary. Is there any reason she would be inadmissible that you know of?

To the best of my knowledge they never do an out and out denial. I think what she got was a 221-G which is technically an "Intent do Deny". They will furnish a reason for the intent to deny and you have 30 days to disprove the reason for denial. They will likely want more evidence that the marriage is bonifide and not an immigration scam. Usually a 221-G can be resolved. If you have not provided enough evidence in that 30 days the procedure was and probably still is that the application is returned to the USA and you can appeal it there but that is usually much more difficult. I think you will be ok so don't panic.

12/14/2006 Applied for K-1 with request for Waver for Multiple filings within 2 years.

3/6 Called NVC file sent to Washington for "Administrative Review" Told to call back every few weeks. 7/6 Called NVC, A/R is finished, case on way to Moscow. YAHOO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
7/13 On Friday the 13th we see updated Moscow website with our interview on 9/11 (Hope we are not supersticious) 9/11 Visa Approved. Yahoo.
10/12 Tickets for her to America. I am flying to JFK to meet her there. 12/15/07 We are married. One year and a day after filling original K-1
12/27 Filed for AOS, EAD & AP 1/3 Received all three NOA-1's 1/22 Biometrics 2/27 EAD & AP received 4/12 Interview
5/19/08 RFE for physical that she should not have needed. 5/28 New physical ($ 250.00 wasted) 6/23 Green Card received
4/22/10 Filed for Removal of Contitions. 6/25 10 Year Green Card received Nov, 2014 Citizenship ceremony. Our journey is complete.

Shows that there is something very different about their case. I can't remember but maybe the OP can give us the Cliff Notes version to refresh out memories. Interview back in November and then AP and then a call and now in March......not a typical case for sure. Hope the OP understands that and knows about what it may be.

I might have jumped the gun. This is a copy of the letter that was returned with my wife's documents.

Section 221g of the Immigration and Nationality act (INA) prohibits a consular officer from issuing a visa to an alien if the c onsular officer has reason to believe that the alien is ineligible. Based on indications that petition (BAC-1290687077) contains inaccurate information, we are returning it to the Bureau of Citizenship and immigration Services (USCIS) of the Department of Homeland Security (DHS) for review and possible revocation. If CIS determines that the information we are providing constitutes sufficient foundation for initiating revocation proceedings, you will be sent a notice of intent to revoke that includes a statement of the facts and evidence, and you will have the opportunity to respond . Under INA 222 f , which addresses the confidentiality of visa records, we are unable to provide any futher detail.

Still vague but many times these are re-affirmed and returned to the consulate for a new interview.

Yep she was denied. The file is being sent back for revocation. Most likely they think your relationship is not legit.

To me it sounds like they think it was some misrepresentation about your wife in petition package or during interview. Try to think together with your wife what it could be - anything from her life that was in petition package or in answers during interview, about what consular officer could think is not truth. Feel very sorry for you, but it really sounds like they denied petition.

Or.....there is something in your wife's past that is coming around to muck up the works?

Past marriages, not properly divorced? Past visa attempts? Previous spouse is also presently attempting to obtain a visa? (We've seen that coincidence.)

Something is making them believe she can not be issued a visa. I don't think misrepresentation but more she is not eligible.
