Maybe an attorney will help, it will be tough going. The ball is in your court to prove this is the real deal. I would have cleared up the first issue before filing.

I seems you are bent on marrying for immigration benefits...they will give you a rough time even if U get an atty and get married.

2 petitions????

In 2 years with 2 different people. IMHO and based on what I've read on here is the crux of what the OP has to defend to prove to the embassy .

its not for immigration purposes. My first petitioner is very abusive guy that why I decided to end our relationship. and after 2 years I found this loving man who is willing marry me.

OP, learn to not use the word willing when talking about your relationship to others. To me, it reads as if you were shopping for a USC for marriage.

Good day. I am Joyce from philippines who recently had an interview last Jan 2013. My case was put on hold due to the fact I have multiple petition. I have 2 k1 petitions filed by 2 different fiance. first petition filed march 2010 and 2nd petition filed April 2012. I dont have any communication with my ex-fiance since he verbally abused me back then. Can Anyone help me what to do with my case since USEM returned the 2 petitions back to USCIS. When do I expect to hear from them. Any help will be greatly appreciated.Thank you

Depending on the service center you were processed at will have alot to do with if you will move forward with this K1. In most cases they just let them expire. It will be a few months before your petition even leaves the embassy and comes all the way back to NVC than USCIS where they will make a decision what to do. If they bother at all.

It's not priority one so many times they just sit. Has your fiance' called his congressperson or senator and get them on it.

In your case marriage man not even be the answer. You will have a tough case to prove a bonafide relationship. It can be done so get your ducks in a row.

In the 1st petition who cancelled it? You or him?

Also you have no idea what he may or may not have said to immigration to hold you up in the future. You need to realize that. I would do a FOIA (Freedom of Information Act) form and get the notes on the denial to know exactly what you are facing. A call as I said before is needed to your state reps on monday. The ball is all in your court dear.

Yeah, but if she said something like that in the interview, it screams fraud. I at least got a CO (for the first interview) who was very, very unaware of a lot of aspects of my husband's culture. Maybe that's what happened to OP.

I couldn't agree with you more. After I first met my fiancee' one of her relatives (Filipino) asked me if I intended on "claiming" her. Not a term we would commonly use here in the states but I didn't take it as any kind of demeaning attribute for either myself or my fiancee'.

No offense but the OP shouldn't be worried about your perception but the COs.

Looking at it fairly objectively it does appear like you're in it for the visa. You had two K1 petitions filed almost exactly two years apart. So, after filing your first petition you eventually break up... Maybe six to eight months? That means you had to find a new fiance, pull together all the paperwork for the petition, meet each other and establish enough evidence of relationship in just 1.5 years. You didn't find this guy "after 2 years," you had to find him within a month or so of breaking up with your first fiance in order to meet this timeline. Unless you knew the second fiance while the first petition was processing... I'm just thinking along the lines of the Consular Officer. This is what he or she will see. Good luck!

Also they are two petitions within really just over 2 years.

You also originally said the first one "was abandoned since USEM asking my ex-fiance for a financial support thing but He cannot provide", not because you were abused in any way. Expect to be asked about this when the time comes.

Hello Joyce;

Your case is somewhat tough to get through since you have unreconciled previous k1 petitions. And the fact that its 2 different petitioners would give it an alarm to USCIS. One thing you can do is; try to find a way to get contact to your ex-fiances and ask to withdraw their petitions they filed for you. And I wish they wont make it hard for you. Even when you get married to your new fiance now; filing for a spousal route is not a guarantee that you will get a visa. It will still be storm with lots of questions; delays.

I am in a similar situation. I talked to a number of lawyers and was told two difference things. Here is what happen with my wife. She did have a boyfriend who did get a K1 visa for her and the girls. They were approved and in October 2011 he canceled the visa. I was worried this would make it harder for us to get the same type K1. One lawyer told me if we were married we would have more rights. Then I had a number of other one say that the K1 would be OK. Finally had one say if I married her it might make it harder. I did marry her and I just sent my I-130 for her and the girls. So I let you know what happens. We do have emails and in her passport that show the canceled K1 visa and she went to the consulate to have that done. We also have a email for the person telling her why he canceled it. We were told that when we get a interview this is were we would have to present this proof. I just sent my packet today 3/15/13. It sound like you need a lawyer to help guide you since you have been denied. I wish you luck

hello... I have a follow up question... what was in her passport that shows the cancelled k1 visa?? How did she got it??? she went to the consulate?? May I know the details please. A response will be greatly appreciated.Thank you.
