aidar Uscis won't ever question anyone because the individual submitted the AOS papers one month after the marriage, you can submit anytime you have the marriage certificate. In your case I think the problem is that he got marriage as soon his divorce was finalized, despite he was living with you 1 year before the wedding.

At the time of the interview he asked my husband that question. Why he married immediatly after the divorce and he answered the true because his ex wife did't want to gave him the divorce even thought they were separated more than a year and the officer seemed like was fine with the explanation. In case that this or the others thing mentioned before the red flags. What's next? What we can do? How can we fix this?

Getting married right after his divorce, meeting through mutual friends... him out of state when they showed up (how often is he gone?). You also said he appeared very nervous during the home visit. Understandable, but still something they most likely took note of.

I see some red flags definitely adding up. Keep thinking of any others as these are the things that you need to overcome.

If those are the red flags. What should we do to resolve this? What can we expect now?

Sorry, I have one more question. How often our lawyer should communicate with us? We had the first appointment with him last thursday ( one week ago) when he took the case. When can we expect information from him? It is too soon to knows something from him?

It may be that you not know of it, but ...

who is who? who is beneficiary, who is petitioner, and

what visa did the beneficiary hold prior to marriage to the petitioner?

what visa did the beneficiary hold prior to marriage to the petitioner?

I'm the petitionary and my husband is the petitionary. He had a tourist visa before marriage.

We just had to wait to married because my husband ex wife didn't want to give my husband the divorce

Husband here on tourist visa, but ex wife in USA as a citizen or other tourist visa?

Perhaps the IOs think this couple came into USA, divorced, and both have married other people then filing AOS.

OR

Perhaps his 'thing' was to file AOS with his prior USCitizen wife, and she did not do that for him, for what ever reason,

and

the IOs smell something fishy.

Apologies, all is conjecture and opinion on my part - I can't say precisely what's going on in their (the IOs) minds.

Yes, he was out of status when I married him. That's why he didn't have a valid driver license.

We just had to wait to married because my husband ex wife didn't want to give my husband the divorce

His ex-wife was on a tourist Visa too. I think she is out of status.

I'm not sure what you mean with or without inspection. I guess you mean if he has an I-94? If it is that yes, he has it. He came in a comercial flight.

No one can answer how often your lawyer will contact you and what you can expect in regards to his communicting with you.

You hired him, you paid him so call him as often as you want to for possible updates.

The out of status/tourist visa/divorce/marriage thing is of concern to them. They will investigate until they are satisfied

and then contact you or your lawyer with a decision. This can take a while from what I see with other home investigations.

I don't suggest any more out of town visits, perhaps his child can visit him instead.

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

OP, I'm sorry to hear about your situation. But a lot that was mentioned in this thread as Red Flags wasn't a problem for my wife and I.

I came one a B1/B2 visa in 2001 and overstayed.

I was married before, so was my wife.

She is 16 years older than I am.

We got married the same month her divorce was finalized and filed AOS a month later. And non of those things were a problem at my interview. We were interviewed for 15 minutes and I got my green card.

So there may be something else going on with your case. Hopefully you and your lawyer can get to the bottom is of it soon.

Thank you so much for replied. I'm so glad you did because bring to me a little bit of relief. I was getting more nervous than when I came to this forum. Your case is very similar to ours and get me much more hope. Thanks so much again for shared your case it help me a LOT.
