I am quitting my job and moving back to canada shortly. I would like to visit my wife in the USA before I go back to canada to wait for approval of our I 130.

My fiance was told by a congressional aide that I should lie when to immigration at the airport to avoid being denied entry. I really do not want to lie as I think it could put at risk our I 130 mpetition. Does anyone have advice on this dilema?

Advice?

Yes, do NOT lie! It can lead to a lifetime ban. It is easy to tell someone to lie when it isnt their life and future on the line

Why do you need to lie?

Pardon me i am confused. You say you are quitting job to go to Canada. You want to visit your wife but you say fiance says congressional aide says lie to CBP . So lie about what exactly?

Denied entry from a Canadian going to US?

Not at all.

It's completely up to the discretion of the POE officer, but it's the same if you're just visiting and not even married to a USC.

Carry ties to Canada and never lie at the border.

And get the person that told you to fired.

The only thing they may have an issue with is that you have recently left your job. If you are starting a new job in Canada, or have money to support your stay I would provide this information at immigration, so they don't think you are planning on staying in the USA.

I came in and out of the US several times while my I130 was being processed, and as long as you have return flights and no indication of trying to stay they should be fine. But as everyone said, don't lie. It's just not worth the risk

The only thing they may have an issue with is that you have recently left your job. If you are starting a new job in Canada, or have money to support your stay I would provide this information at immigration, so they don't think you are planning on staying in the USA.

I came in and out of the US several times while my I130 was being processed, and as long as you have return flights and no indication of trying to stay they should be fine. But as everyone said, don't lie. It's just not worth the risk

Would a letter from a possible future employer in canada help ?

In my experience, they just want reassurance that you aren't going to try and work illegally or dissapear into the country and never leave. So anything that ties you to Canada would work. Probably not a potential employer as it isn't certain enough. Do you have any info to prove where you will be living when in Canada? Documents showing home ownership or lease info may be good.

You may be just fine and a return ticket is the only proof they require, but in my experience they have always wanted to see some kind of documentation to prove I wasn't staying.

I have been in and out of USA . I am on visa waiver and make sure that I do not over stay each time. On my last visit on 19th Feb 2013, the immigration told me " DO NOT LEAVE TILL YOU GET YOUR GREEN CARD" and give me more than 90days on my pass port. They wrote down specifically " WT until I30/green card approved" :)

And oh yes.. it is expensive to fly in and out.. but all worth it. I usually take a vacation in a near by country when my time is due and re-enter again so I reset my clock back to 90 days.
