thank you everyone for your ideas and thoughts about this...and on a side note, it was a mistake that he even left the US 3 years ago..I should have married him then because i wouldn't be going through this now :( I do understand the process and how long this could potentially take, all the lawyers I've spoken to can't speed it up. But, what I'm really annoyed about is the fact that people who have applied after me have already gotten approved and I don't think it really matters where the spouse is from except basically some people luck out. His cousin married an american and was in the US within 7 months of her applying and in a few weeks it will be 7 months since I sent in the I-130 packet and I have no answers...and by the way, the situation is getting worse especially when the israeli government is not releasing funds to allow civil servants (government workers) to be paid, so palestinians haven't gotten their salary since November :(

Heres my 2 cents

The K3 was started years ago when the approval time for petitions was 18 months to 2 years.

They stopped approving the K3's when processing times came down to the 5 month mark a couple years ago

Yes a few K3's do get processed on a rare occassion but not routinely

So, now that the processing times are getting longer then the K3 might in fact come alive again to speed up processing times.

I am not sure of this...it is just my 2 cents

Our government probably started losing alot of money since people knew the K3 was a waste of money and now with the great influx of immigrant (illegals) added to the caseload and the need for more money....just maybe the K3 will be in effect again

But at 7 months I think I would not add the 129 because you could be approved in a few weeks. and if you send the 129 it might take a few weeks to get it attached to the I-130

But there have been a select few who have waited over a year for NOA2 from the middle east. Thank God it has not been many but it has happened

Incorrect, USCIS never stopped approving petitions filed to start the K3 process. They started the practice of tying the two petitions together back in 2006. It was the NVC that implemented the procedure of administrative closure of the K3 in 2010 only when an approved I-130 is on-station.

The provision in the LIFE Act that created the K3 has never been repealed and thus, the K3 couldn't be "in effect again" because it has been on the books ever since the LIFE Act was signed into law.

But at 7 months I think I would not add the 129 because you could be approved in a few weeks. and if you send the 129 it might take a few weeks to get it attached to the I-130

I-129F would be the applicable form; the I-129 is filed by employers seeking non-immigrant workers.

I know most of what I have said is mainly semantics, but in a process as bureaucratic as this where the tiniest thing can mean the difference between success and failure, it's important to have information that is completely correct for the benefit of those who read these forums for information but have chosen not to actually become members.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I wouldn't suggest wasting your time with a K3 visa. I tried it, filed an i-129f as soon as I received NOA1 for the i-130 (which was six months ago), but apparently they keep the two petitions together and once the i-130 is approved, the i-129f is going to be closed. Officially, the K3 is still on the table, but it just doesn't work in practice. Although there is now no fee for filing the i-129f for a K3 visa...

ALLYINCHICAGO, why would you use this page for political discussion? So you have every possible kind of freedom in this country, and you are complaining about being slightly late in getting your documents processed when other folks have waited patiently for months. And by the way, your husband does know that this country supports Israel, right? I suggest moving to Iran, they have been much more supportive of the Palestinian people, and I bet that their I-130 petitions take less time. Have you possibly tried that?
