Hello VJ members....i have got married with my USC wife is 2011 and we have our NOA1 and NOA 2 approved,and we are at the NVC now,,,we have paid our AOS and now remain our IV fee.... and its about one and half year now i and my USC are in a big fight we are not talking anymore...please i know this is very stupid,can i have an attorney or someone to proceed with this process for me without my USC wife .

I would say, Why don't you go talk to her then? Love is forgiving. If you truly love her and want to keep her forever then fix you two's problem and make everything fine. I think she would be mad at you if you get an attorney for that without talking with her about it, because it definitely would seem like you don't trust her anymore but that's your life. I would say do whatever you think it's right.

Why would you want to proceed with the process without her? Isn't the only reason you are moving to America because of your wife and the love you share?

This is a ridiculous question but you already qualified it as "stupid" so I'll go ahead and answer anyway. There is no one (not even the U.S president) who can help you proceed with the process without your wife. And, to satisfy my curious ears, why do you want to come to America when the reason for which you're coming aint working? Your wife is the petitioner (the reason you're being considered a potential immigrant) and she's only legalized to file for you because she's your spouse. If there is no marriage (unless you guys solve whatever problem you have), there is no petition. No attorney can help you; they don't have any legal basis to help you. Only those you have relationship of intimate dealings with (wife, parents, etc, provided they qualify under the law) who can file for you.

If its so serious that she isn't talking to you to the point you feel you need to progress without her WOW shame on you.

But if she's a smart wise woman she would have pulled her AOS and you wouldn't be able to immigrant anyway.

No wife support why do you really want to come here? Hmmmmm not wise dear but hey I have read worst here.

The petition is based on your marriage and your bona fide relationship. Without an immidiate relative, you cannot immigrate. Being married to a USC doesn't help you or give you the right to immigrate. It gives your wife the priviledge of petitioning you. If your wife no longer will vouch for you(affadavit of support for instance), then you're back to square one. It's understandable that she won't if you're not planning on getting back together. Not only would it be anything but a bona fide relationship, she would also have to trust that you would never become a public charge since she could end up with that bill, she could also be misrepresenting herself which can be quite a large sum of money/time besides having it in her police record.

I suggest either patching things up with your wife because you want to be with her, or you look into divorce. Keeping it together because of immigration most likely won't hold water. Immigration isn't over until you choose to become a US citizen. ANd by that time, your immigration file is up for review again. Even IF you got to the US and divorced, you won't be living happily ever after in the US.

It's not really a stupid question however it is naive to believe that anyone should feel obligated to the financial responsibility of an exwife or exfiance(e) when the relationship ended before they were even on the same soil. I'm the immigrant btw. I already have a life here but would instantly flipflop my way back to home country if my husband wasn't my husband.

It's your wife's petition. No one else can take over that petition. If you want to move to the US regardless, you can look into other visa categories.
