Hello everyone,just hrd about this forum that it really helps alot.

I am legally married to an LPR in 2009 before he left for the US but i applied for a tourist visa sometime in 2010 and said i was single in the form i filled online.my visa was denied during the interview based on INA 214.my husband has now filed for me and i have been called or an immigrant interview next month.do u think my tourist application in 2010 would affect my immigrant visa being issued?

NEVER try to cover a previous lie with another lie. They have your records and it will make your case worse(could incur permanent ban to the u.S.). be honest and hope for the best.

09/26/2012: Mailed I-130 from Nigeria( delayed by customs)
USCIS stage ( 66 days)
10/12/2012: NOA 1
12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK


N-400: (3 months and 12 days)
Filed N-400 : 2011-06-17
Interview: 2011-09-27
Oath Ceremony: 2011-09-30

IR-5 for Mom Entire process took 5 months exactly
USCIS (22days)

mailed I-130 : 2011-09-30
NOA 1: 2011-10-03 (text & email)
NOA 2: 2011-10-25 (text and email)
NVC: (19 days)
Case entered and # assigned: 2011-11-18
NVC Case COMPLETED: 2011-12-07 ( 43 days from NOA 2 and 65 days from NOA 1)
Interview Date(Lagos): 2012-01- 23
Mom was late for interview
New Interview date: 2012-02-29 : VISA APPROVED

Newspapers name change is publicly declaring that you are married n wish to be addressed w ur new name

This is the first time I've heard of this here on VJ.

Anyway, married is married. If they ask about the previous visa, just tell the truth.

Essentially, you lied to the US Embassy and you want to know if your lie will hurt you?

Yes, it will.

You lie will mean that what you say is put under greater scrutiny.

If a person lies to you, would you trust him to tell you the truth next time? You probably be less trusting, right?

That's the position you have put yourself into.

In no country does a legal marriage requires a newspaper publication. You knew you were married in 2009. You know you lied, so that was why you got the denial for misrepresentation on your tourist visa.

Good luck, and let your case be a warning to others who have legal ways to come to the US ruin them with lies.

Did your husband get his green card as an single man, then marry you before going to the US?

You know what he did. He lied that he was single when he enter the US in 2009 using a visa for an unmarried child.

How are you planning to deal with his immigration fraud?

Single in 2009 for his visa in one set of documents. Married now because its convenient to petition for you. Two sets of documents - one single for his visa and at the same time married for your visa.

Very poor choices.

Lagos is a super tough consulate and they will not take your fraud lightly. What they will see is Husband travels to US on DV visa, issued to him as single, but he was actually married when he entered. Wife tried to avoid proper process by applying for visitors visa as single the following year. ( because it is presumed your intent was to arrive and stay this is a HUGE lie ) I would bet that you are going to be denied again based on the previous misrepresentation and you will be very lucky if Lagos doesn't slap you with a lifetime ban.

This will not be over quickly. You will not enjoy this.

There is such thing as newspaper name change in Nigeria but its usually useful for those previously married . They notify all members of the public,banks etc to tke note that " Mrs T . John" now wish to be addressed as "Mrs T. Paul" and all documents still remain valid. So she's Right bout the name change but I can't relate it to her case as its not necessary being that its her first marriage(unless it's not). I'm thinking u shud be prepared for that interview cos hey the CO is gonna throw u with the question of why u filled out "single" when u knew u were married! And that's not good! Anyways..GOODLUCK

There is newspaper publication but it does not pertain to those previously married. It isjust a a way of announcing "hey I am now married in case I come to you with another name, it is still the same me who you used to know as Miss so and so but now I am Mrs so and so..." I has nothing to do with the visa case though, cos once married you are referred to as married from the next second and must answer so in any document regardless of whether you did newspaper publication or not.
