Had twins! Are they 'evidence'?

So my husband came over on his K1 Visa and we were married in 2011. We need to file for his removal of conditions in July and I'm reading up on things people include so I am prepared. We almost had our K1 denied due to lack of evidence when we initially filed in 2010. We got an RFE instead and didn't have to re-file, Thank God... But it was an overwhelming amount of stress that I'm hoping to avoid this time around!

We were blessed with twins in November (obviously conceived after we were married.. about 9 months after the wedding, so there's no question of that...)

Do people include children's birth certificate copies showing that we are the parents as evidence with their I-751? Of course we'll be adding other things too, such as tax forms, bank statements, car loan with both names on it, etc.

They don't go 'easy' on couples who have had children together, do they? I mean, that's obvious evidence we're still together, right? :)

Yes people do include childrens birth certs. Its a very common thing to include, even with citizenship applications.

Including them wont make it " easier " no. People can have babys with their spouses even if they are split up or in the middle of a divorce and babys happen when you aren't married or aren't dating someone too.

Nothing is "obvious" or logical with our government but having the kids together could help you prove a bonefide relationship at least it won't hurt your case....BTW congrats on the twins :thumbs:

Yes the birth certificates are considered evidence of relationship.

They don't always go easy on couples with children no. To be blunt they're proof the female had sex, that's all. We all know the stories of people getting pregnant by one night stands, or divorcing their spouses or whatever so while they're good evidence, it's not like if you sent ONLY that you'd be fine.

Actually, there is a member here who decided to ONLY send the birth certificate of their child, nothing else proving relationship. He hasn't been approved yet, he just filed. They too thinks "hey we have a kid, obviously we're committed right?" no. Proof the female had sex and the other spouse claims the child as their own, nothing else. Ever seen "Maury"? Plenty of people lie about parentage :S

Send your other evidence as well, especially proof you live together and financial co-mingling and you'll be fine :)

As others said, send as evidence, include other stuff as well.

FWIW when we did our initial AOS the evidence we included was just the birth certificates and one bank statement thanks to stupid advice from our lawyer before I knew anything about the process. We had an interview and they grilled the hell out of me. :lol:

Ah, perfect. We were going to send lots of other things, too. But it's good to know how they view children in this process. It helps prepare us. And with the twins, we need as much time as possible to prepare!

We have a ton of evidence... bank stuff, taxes, car loan, joint lease, birth certificates, etc. And of course, we will dazzle them with lots of pictures of me and him with the twins. :)

Thanks everyone! You guys rock! :) Certainly not going to end up with a lack of evidence and stressed out because of it this time.

A birth certificate will be fine as evidence as long as your case isn't strange. As someone said in the other thread he knew people who only sent the birth certificate and were approved.

It seems a little convoluted to write the fathers name in the certificate just to provide evidence. The birth certificate is a powerful document. Legally it means the father has to support the child for the next 20-odd years.

The RFEs that people provided as examples all involved some weird circumstances.

One common theme was a change in address from the AOS (i am still not sure the people had filed an AR-11, but maybe they did).

SOME of the RFE's are for weird circumstances, not all.

A poster claimed people were approved with JUST the birth cert? Can you show me that post and posts proving that? Honestly I'm interested to see what happens with you. Especially when I provided you with a link of someone who had 2 kids, one who was a step-kid for the USC and the other that was a disabled child that he stayed home with. Their case wasn't "odd" in my opinion and they provided more than their childs birth cert yet were RFE'd. You'll be the true test story, I'm still banking on you getting an RFE.

I have no idea why they were RFE'd, but the couple to which you linked had their child before the AOS. I honestly don't know why a child isn't enough. As I stated above, the birth certificate is the most serious document on which your name will appear. As a man will will be legally supporting that child for 20 years if you live the USA. What bigger sign of commitment can one make? Every other bit of evidence can be forged, but a bit harder to forge a baby.

The other thing I would consider is that my wife and I still live in the same address as our AOS, we filed taxes jointly before AOS. All that evidence is still there in teh file. So even if there is no RFE it doesn't necessarily mean it will be fine for everyone. It will always be case by case.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I've just filed in the past 2 weeks and I included our baby's birth certificate among other things. Have a look at the link in the Vanessa&Tony signature for Vanessa's list of documents used for filing. I found that super helpful and was able to put my papers together in about 3 hours using that as a guide!

There is a post on here where someone posted a copy of their RFE letter asking for more proof of relationship. One of the suggested items in the letter were if they had any children to include proof.

Children are of course ONE element of proof but not solely.
