Question for friend--divorced a 10y GC holder.

Ok....friend divorced her ex husband when she found out there was ANOTHER woman in his home country....actually rumored to be his wife.

Apparently there was this elaborate plan where his brother here in the USA set his coworker/friend (my girl friend) up to marry him telling her all this amazing stuff about his brother and 'hooking' them up over the internet....well she REALLY liked him...charming, sweet, cute...just a 'perfectly sounding package' well she met him a couple times in his country....and finally he came on a K-1 visa...they got married...it was all fine till he got his 2yr GC and started working (for his brothers company) and every penny he made he put in a separate account she had no access to not even knowing the amount in there....he traveled back to his home country several times a year not taking her with him.....and began being shady....well time for ROC he decided to take her on this nice vacation and blah blah....ok he gets his 10y GC........and the FIRST thing he does is move out in to his own place...claiming they need a little break...at this time she began to dig and dig and got lucky when he accidentally had his facebook password be attached to his email when you touch the log in...she quickly takes that and goes to snoop.....and found thousands and thousands of messages with some girl (she suspected always because this number would call him from home several times a day but he claimed it was his mom) she printed them out and asked a nother friend to translate...and EVERYTHING came in to light.......that was the truth-- this girl was asking him ho much longer till he was citizen and when will she be coming to be united with her husband and so on and so forth. Inappropriate sexual messages and just random talk-- even bad talks about her (my friend) and how shes nasty and all these horrible things.....

lets just say he was served divorce papers and freaked out begging her not to divorce him right before his citizenship....she heard that if she divorced him he wont be able to get it for 5 years and she thought that would be the perfect revenge on not being able to bring his 'wife' here fast enough....she would have to wait a bit longer. He begged her and even had the audacity to say 'how can you do that to her? we love each other she deserves a good life as well' LMAO (If I was her I would have b*tch slapped him so hard)she notified USCIS of the divorce and a nice long letter and that was it.....well aperantly he went to his interview alone and told the IO she cheated on him and left him....bwahahahaha....but that was it....never heard anything else...

so question.....does he really have to wait 5 years to get his citizenship?? Or can he get it any time?? Also.....to bring a spouse or fiance or whatever (never sure if he was really married to that girl or not or if they just referred to each other as husband and wife) I know takes years to bring as just a GC holder....honestly I hope the b*tch never comes to the US...she was just as much apart of this elaborate scam as he was.

PS--my friend is now married to a really good man and very happy....

Since he's divorced from his US Citizen wife, he will have to wait until 5 years from the date he was approved for his 2 year green card. Also if she has email proof and Facebook proof maybe USCIS can prevent him from ever getting his citizenship because of the fraud he committed to get his green card in the first place, but I'm not sure how that works.

Good Luck to your friend. It saddens me to see how people hurt someone else just to come to America.

Well anyways, since the ex husband was divorced by his then K1 petitioner, his 3 year wait to become a citizen will now become a 5 year wait.. If he's done with the ROC, he has approx another 3 year wait before he can file for naturalization.. ( well that's from my own understanding..)

And about him being a green card holder and wants to file a spousal visa for his wife from his own country ( a green card holder cannot file for a K1, he has to wait to become a USC.), I think it will take longer than a year since they will have to wait till their priority date becomes current so they gotta wait longer than a year I bet, depending on their country. They will have to check on the current visa bulletin if what priority dates are being processed right now.. But as soon as the guy becomes a citizen, a visa will become available for the spouse and will speed things up..

Well given the timeline in the OP, and given you said he was "just before his citizenship interview" and that it was 2 years ago, then he's likely eligible now.

If they can prove there was fraud (hopefully she also reported him to ICE) he can actually get his GC revoked and be reported. If she had all that proof that's what I would have done.

Sorry for everything happened to your gf but i learn from life that we have to hear from both him and her .Actualy what drives me nuts when the the husband from here ( Morocco ) is very honest sincere ,he got denied very easier in the Interview and we hear like we do not trust in your relationship.Coz of some jerks like your gf 's ex husband who use women over there everything.You can Imagine now how the Co look at other men from Morocco ,for them we are almost the same like that guys.I'm one of them coz again coz of the guys like that we were refused our visa .I wish ehr forget about him and move on coz as she was right honest belive me there is someone else for her anyway he is loser not her .Good Luck

Well given the timeline in the OP, and given you said he was "just before his citizenship interview" and that it was 2 years ago, then he's likely eligible now.

If they can prove there was fraud (hopefully she also reported him to ICE) he can actually get his GC revoked and be reported. If she had all that proof that's what I would have done.

I know that there are some AMAZING Moroccan men!! Im married to my best friend and the love of my life...I could not be more happy...we are inseparable and there is no hiding in our relationship we party together, we go out together and we have all the same friends...actually people make fun of us and tell us were like high school kids hahahaha 3 years and still going very strong....

All my friends are Moroccan so I know not all are bad...but there have been a few I have known personally who married for the wrong reasons (most of them are older and wound up divorcing after their citizenships to marry Moroccan women).....he being one of them (I actually met my best friend THROUGH him.)
