I received a Request for Petitioner & Beneficiary to Appear for Interview for January 16, 2013 from the local field office for my I130 Petition. The letter requests Original Documents. When I called USCIS all they could tell me was that an officer wants to asks questions about my relationship and see original documents. Has anyone else received such a request? If so, what happened afterwards?

It can be two things one they may be thinking you are filing an Adjustment of Status and think your spouse is here in the states. Or they suspect fraud and want to see what you have. It's not a blessings. Hopefully it will go smoothly.

Was there ever a overstay or illegal entry? Or were they petitioned from someone before?

I would do a search on VJ there are alot of Topics on this subject. You need to get your documents together. But nothing to be scared of.

He has never entered the US or been petitioned by anyone else. I guess I'll gather what I have and take with me to the appointment. This is the petition I forgot to include proof of relationship.

local office interviews are something new, since casefiles went off to MSC.

Apparently some of the local offices not follow adjudication guidelines and rules that CSC and VSC use.

However, you not include the evidence asked for in the I-130 instructions, so you have an opportunity to bring it in.

As for 'both of you' - I'll claim it's a data error, as someone thinks (perhaps from lack of stuff in the casefile that you submitted) that you're filing an I-130 for an adjustment of status casefile and NOT a petition for a spousal visa.

I think that if they want to see original documents you should either get certified copies or at the very least photocopies to leave with them as well at the interview so that you're not leaving your originals in the hands of the USCIS.

The letter looked pretty generic and requested the following items:

* The interview notice and Government issued ID

* Your Original Birth Certificate

* Beneficiary's Original Birth Certificate

* If based on marriage

*original certified copy of your marriage certificate

*supporting evidence of your relationship

* Bring original and a photocopy of all documents listed above for which you DID NOT previously provide a photocopy

* Bring the original of each supporting document that you already submitted with your petition. You do NOT need to bring another photocopy of that original

I submitted most of the documents with the original petition. The only thing I failed to include was correspondence between my husband and myself.

So, the originals are in the A File.

If the local office doesn't have your A File during the interview,

then reminding them to 'pull all from the A File' will be useless.
