Travelling within the US with no green card yet and K1 visa expired

Hi everyone!

I came in the US in August on a K1-visa, my visa was good until November 1st, we got married on September 14th, and we applied for the AOS right after. The question is if I can travel within the US if I didn't get the green card yet. I am worried that the officer at the airport will see that my visa is expired and he won't let me get on the plane. Should we prove the we are married? Or how does it work? We are thinking to bring with us the marriage certificate and the AOS NOA1. Any ideas?

No problem for travel within the US. They will just look at your passport biographical page, or you can even show a US driver's license if you have one.

Just don't leave the US or do not have a stop outside of the US.

Take a copy of your NOA and marriage certificate if you want to play it safe, but really, they should really not ask you about it. You are not going to go through an immigration booth, as you are not going to enter the country (you are already in!).

BTW, your visa expired the day you used it, I guess you meant your I-94 expired on November 1st.

Thank you for your reply, now I feel relieved. Yes, I meant about the I-94. I don't have a driver licence nor an ID, it was impossible to get one without the green card.

Yes, I understand that.

I travelled recently within the US, after my I-94 expired, and with my green card in my wallet. I did not show my GC nor my driver's license, just my passport... no problem. :)

Driver's license usually expiures with the i94. Passport is fine. And if you're really concerned, bring a copy of NOA1 from AOS.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

Hi everyone!

TSA only cares about valid ID issued by an official enitity--US government, US state government, Foreign government. So your passport should be used as your official form of ID when traveling within the US. Just make certain the name on the ticket matches the name of the official ID you are using. This is true for international travel as well should your GC and passport name differ the travel document must match the passport (GC is only used to gain re-entry to the US).

My wife and my MIL traveled within the US using their passports as ID. No problem. The TSA agent never looked at my MIL visa, and my wife's I-94 was expired and she did not have her GC yet. We did not take the NOA1 with us. I have used my US passport to go thru the TSA for domestic flights. All they do is look at the bio page and compare that name with the name on the ticket. They are not CBP and do not care about proper visas and all that as it is not they job.

you can travel with in the US with your passport - no problem. My husband and I were worried about this same issue as I had bought plane tickets for a couple of different trips before his ap/ead had arrived. Airport security only looked at his passport bio page. Didn't even check for the 194. We had brought our NOA1 with us just in case but it wasn't necessary either trip. I had actually called USCIS to ask this question and they said travel in the us would be no problem.

Scott76 we were in Denver last weekend - my husband is from Romania -I'm sure he would have loved to speak Romanian with you!

At some U.S. airports, CBP hangs around the TSA area. Therefore, carry the NOA1 with you.

I insisted that Mrs. T-B. carry our marriage certificate with her, everywhere. It paid off a couple of times.

Wrong, at some airports or due to "orders from above" they will check if you have a valid visa and the only way they will let you go after seeing that is expired is by detaining you and verifying your status, meaning that if you have your USCIS receipt (the one that says that they got your paperwork, etc,etc and your Marriage Certificate) you won't go thru the "getting detained part". An Ex of mine got detained when she went to see me and forgot her driving license but she had her old passport and it was a freaking nightmare. This happened at Tampa airport, and I have seen it happening at some other one, mostly the "international" type that have an USCIS office.
