I think the best thing you can do is to go and get married ASAP. I feel awful about the news, as I was so sure for a better outcome. Even now I wonder if chiming my two cents will help. However what I have heard and what I agree with is getiing married to your love. I've read the denials are less, and it may take less time than to wait for reaffirmation from USCIS.

Anyone interested, give him a call. There is no cost for his class action suit. It may not help anyone's current case but it when

they get enough law suits things will change for those coming behind us some day.

It is an unfair broken system. CO's are actually re adjudicating approved petitions which they are not allowed to do.

CSC refuses to review K1's and allows them to expire and there is something very wrong with this system. All it takes is a renewed validation

and a review. That is all we are asking for. Vermont does it and so should California.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

So after much discussions with my Fiancee we will try for the marriage visa but I have to restock my savings account back.

The only concern I have is what do I need to do with this petition? I am assuming that since they made an allegation of non bonafide relationship that I need to respond to it at some point.

I'm a little bit saddened and disappointed with the process but I'm not going to let negativity take over me.

I went through a similar fiasco with my K-1 visa petition of my fiance from Lagos. It is a very bad embassy to work with. We were denied in Nov. of 2011, and have been fighting ever since. By the way- we never received anything that looks like the yellow page you have received. The only reason for denial we were ever given was to print at the top of our petition "FOR IMMIGRATION PURPOSES ONLY" . I contacted my attorney (who helped us file), 2 congressmen, 2 senators, the ombudsman in DC, the USCIS, the NVC, and anyone else we could think of that might be of some influence. No one at the NVC, OR USCIS knew what to tell me. Everytime i would ask a question, I would get a different answer. The embassy in Nigeria would not even answer their phone- it rang and rang- not even a voice mail (I got their number from the State website). Since we were getting no answers, (and were being told that they could not locate our paperwork, and could not therefore get a reopening of our case, or a re-interview,) and the time was quickly approaching that our validity period for USCIS was ending, I made an appointment to visit my local USCIS office in Boise Idaho. I took all of our proof, and information (which was not even looked at, at the interview,) to explain our situation, and ask for an extension of our validity period. I was treated rudely by the officer at the counter, and basically laughed at. He said he had no way to extend the expiration date, and told me I was welcome to get more forms and re-file. I found this sooo frustrating. If the embassy is sure that we are trying to "scam" the system, wont we still be "scamming" if we re-file? and- if we re-file and are approved, does that mean that they were wrong with their first denial, and they will refund our money? We have been together for almost 3 years, and it makes me sick that money is keeping us apart. In the world today, it is very easy to meet someone from another country, shouldn't the laws change to reflect an easier way to be with the one you love?? The system is broken. It needs fixed. I want to fix it, but I don't know where to start. I feel your pain, and I have felt it for many years, it never dies, until you are with the one you love. I asked them why CSC lets it expire and VSC reaffirms K1's and was rudely told USCIS NEVER reviews K1's. I told her oh yes Vermont does and why doesn't California....she eventually hung up on me. This was a 2 tier immigration officer, not a service rep reading a script.

She said your case is in storage and will expire and be denied, you can refile. Nice little change they make from all the repeat filings.

Why not do away with all K1's if CO's are allowed to deny them and USCIS refuse to review them. What is the point of a K1 ! :bonk: This sytem sucks.

I'm a little bit saddened and disappointed with the process but I'm not going to let negativity take over me.

CSC does not send out NOID/NOIR letters for you to respond to for k1's. The petition will expire and you can refile. A refile is supposed to "kick in" a NOID/NOIR but not usually for K1's. Should you get a NOID/NOIR letter, respond to it otherwise just refile as it has been expired.

Marrying and refiling won't automatically help until you find out the EXACT reasons behind the denial. Have her reconstruct the interview as exactly as possible, in the fullest detail possible. Better do this rapidly before memory of key detail fades.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

This is a good attitude that will get you far :star:

I am assuming you are correct and will eventually need to address the reasons for denial. Go back through and make a list now of what you originally submitted as proof (see what could have been added), go over the interview with each other and write all the questions/answers down and review it all to determine what may have gone wrong. Also, once you are ready to travel and get married that will be prime time to gather even more evidence for your relationship... another trip, more pics, more family time, etc. Of course along with keeping current records of everything else.

Lagos routinely says lack of bona fide for K1's. When these same refused couples marry and refile they get approved. For most there is no other issue and thus marriage in the Lagos CO's minds overcomes lack of bona fide for "mere" engaged couples. The beneficiary received a note stating lack of bona fide.

Had there been a financial issue or misrepresentation then they would have stated it on the 221g.

The pattern with Lagos is always refuse K1's under the no bona fide BS and approve them most of the time when they come back with a CR1.

Daggone It,I'm so sorry G,I agree with TboneTX,you must find out what questions were asked and try to address the point of hold up.If it were possible to ask for a second interview, i would do that as well, i know you have contacted your congressman but bug them again until you get some help.Again, I am truly sorry about the outcome of today's interview;however i know that you will persevere and be reunited with your Lady soon.God bless you both with strenght and insight to find your way.

Hey Bro...so sorry to hear to read of this delay cos i do not accept the word 'Denied' ...i will like to advice you on this rebound process

1.You may go ahead with contacting your senator to see any help they can offer but dont spend anymore on that lane

2.You have applied wisdom on deciding to go ahead with marriage which is your best option and which is the indirect response they always want to see when a K1 is denied

3.This is another time for you two to prove that you are in this together,this is where you hold your hands to defeat this delay

4.If your fiancee is not working,let her find something to do to keep her mind busy,write some exams or something,she just needs to get her mind engaged as well as you too,though i believe you are handling this well

5.Stay focused....CR1 is the way out

Stay strong bro....it was just a delay not a life long denial

I have no advice to offer in addition to what everyone else has said, but to say I am really sorry to hear this news. You and your fiance' where one of the couples I just knew would get that approval. But as someone said, this is just a delay...Stay strong, regroup, and come back full force!
