K1 Visa Denied In Lagos

I just received a copy of the yellow form that was given to my Fiancee.

What I have done so far is email the Embassy and they responded by saying that "You are allowed to file a new petition, or marry Applicant and file for her to immigrate as your spouse."

So I am headed out the door at 8AM to fax stuff to my Senators.

What else should I be doing?

Other than trying to keep the case there before they actually return it and ask for a second interview (through the senator)there is nothing you can do.

If they give her another interview...be there! I doubt that they will.

When they return it get the diplomatic pouch number to track your case so it won't get "lost." It may take 2 months until entered in the USCIS

system. It gets returned via NVC first before it reaches USCIS, then CSC. Then it will sit in storage with the purpose to expire. The CO stated my case is not closed, we are not denied but USCIS says otherwise. No one takes responsibility to extend the validity of the petition.

Not DOS, not USCIS. Returned K1's at CSC die. It makes me furious. It is an insane broken system.

You are with CSC and they do not reaffirm K1's . I am fighting that battle now. VSC does reaffirm K1's. I was told a week ago by a

tier 2 immigration officer that my case sits in storage and will be denied. Then she hung up on me. She had no answers to my

points I brought up as to why does the CO return it with recommendation to review, why does VSC review and CSC lets it expire.

I see the class action suit link already in your profile so you can contact the attorney, nice guy. I am considering it and spoke to him as I can't

fly back to my fiance until next spring anyway.

The best thing would be to marry and refile or if you can't right now try to fight this insane system.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)

I went through a similar fiasco with my K-1 visa petition of my fiance from Lagos. It is a very bad embassy to work with. We were denied in Nov. of 2011, and have been fighting ever since. By the way- we never received anything that looks like the yellow page you have received. The only reason for denial we were ever given was to print at the top of our petition "FOR IMMIGRATION PURPOSES ONLY" . I contacted my attorney (who helped us file), 2 congressmen, 2 senators, the ombudsman in DC, the USCIS, the NVC, and anyone else we could think of that might be of some influence. No one at the NVC, OR USCIS knew what to tell me. Everytime i would ask a question, I would get a different answer. The embassy in Nigeria would not even answer their phone- it rang and rang- not even a voice mail (I got their number from the State website). Since we were getting no answers, (and were being told that they could not locate our paperwork, and could not therefore get a reopening of our case, or a re-interview,) and the time was quickly approaching that our validity period for USCIS was ending, I made an appointment to visit my local USCIS office in Boise Idaho. I took all of our proof, and information (which was not even looked at, at the interview,) to explain our situation, and ask for an extension of our validity period. I was treated rudely by the officer at the counter, and basically laughed at. He said he had no way to extend the expiration date, and told me I was welcome to get more forms and re-file. I found this sooo frustrating. If the embassy is sure that we are trying to "scam" the system, wont we still be "scamming" if we re-file? and- if we re-file and are approved, does that mean that they were wrong with their first denial, and they will refund our money? We have been together for almost 3 years, and it makes me sick that money is keeping us apart. In the world today, it is very easy to meet someone from another country, shouldn't the laws change to reflect an easier way to be with the one you love?? The system is broken. It needs fixed. I want to fix it, but I don't know where to start. I feel your pain, and I have felt it for many years, it never dies, until you are with the one you love. Action Items So Far:

I already faxed the release of information forms to my Two Senators in California. One Senators office stated that they haven't received the fax (I'll call back as I have the confirmed page) and the others Senators office said they got my fax and they will get back to me within 2 to 3 weeks crying.gif

Other Stuff:

The hardest thing for me is that I am not there to console my Fiancee but I told her to be strong and that this is a process. I feel let down by my adopted country somewhat. I followed the rules, filed out all the forms, paid all the fees, waited in line, was courteous throughout the process and the end result is a generic form letter to an approved petition. I know it's a priviledge and not a right but I have fulfilled all of the requirements that a reasonable person will know about. I mean how does one go about proving a "bonafide relationship", more than all we have been doing for the past year?

Lawyering up is not in the cards at the moment but I will do all I can from here with filing out more forms, calling etc, I am looking for any guidance on that. Other than the Senator stuff, what else can I do? I emailed the Embassy again but I think they are closed.

It' so frustrating.

If all else fails then I will get married in Nigeria when I go home next year but I want to pursue this petition fully first.

I find this message very touching..pls be strong Gowon and Olaskween..I can imagine wht u guys r going thru.So so sorry. Gowon wud advice u to switch to CR1. Godbless u guys in the next step.

Couldn't agree with you more!!! This whole system just seems so unfair sometimes, I have found it seems to be one rule for one and quite another for someone else. Also some of their rules just seem ludicrous!!! Feels like your banging your head against a brick wall for a lot of people on here I am sure :(

and to the OP I really hope you manage to get some answers too!! I am so scared about what's going to happen with our own case so I can imagine how upsetting this must be for you and your loved one :(
