Dear Friends,

I'm reading these post everyday to get familiar with the process. I just replied to my i130 RFE and hoping to get the approval soon. I'm worried about the PD retrogression as my PD is 02/19/13. I read many places that if the case is assigned with Visa number then retrogression will not have an impact & case will flow through. Is that true?

The next question is, at what stage this visa number(Not NVC case no) will be assigned? AOS/DS260/IV/at the Embassy?

Hi all,

I am sorry if this seems like an attempt to hijack this thread, honestly it is not. I only think this may be the ideal thread to ask this question.

I have a peculiar situation. My PD is Sep 9th, 2013 which happens to fall just a day after the current date of Sep 8th, 2013 as we all know. Gosh very painful isn't it? Well maybe not! Just today i stumbled upon this http://www.travel.state.gov/pdf/Immigrant%20Visa%20Control%20System_operation%20of.pdf , which made me realize that priority dates or cut-of-dates are actually grouped into 4 groups. The groups are 1st, 8th, 15th and 22nd. The 1st group is from 1st-7th, the 8th group is from 8th-14th, the 15th group is from 15th-21st and the last group is from 22nd-31st.

If you read this article, you will find out that my Priority date of Sep 9th, 2013 actually falls between the 8th group (8th - 14th). Is it safe to conclude that anybody with their priority date between 8th-14th september 2013 are actually current?

Please explain if you understand any better.helpsmilie.gif

Thank you for your anticipated response.

Not to be a spoil sport but based on the info from USCIS website I don't think that is the case.

http://www.uscis.gov/green-card/green-card-processes-and-procedures/visa-availability-priority-dates

When Visa Numbers Are Not Available

If the demand is more than supply for a particular visa category or foreign state, and cannot be satisfied within the allowable limits, the Visa Office considers the preference visa category or foreign state “oversubscribed” and must impose a cut-off date.

In this instance, only overseas and adjustment applicants who have a priority date earlier than the date listed in the Visa Bulletin may be given an immigrant visa number. A visa is available to an individual, therefore, if his/her priority date is earlier than the date listed for that visa category and country. Visas are unavailable when the chart designation is “U” for unavailable.

For example, if a date of 15Sept02 is shown for individuals from China in the Family 1st preference category in the Visa Bulletin, visas are currently available for individuals with a priority date earlier than September 15, 2002.

If i go by this logic, then with Sep 8th,2013 as PD for F2A today, only applications before Sep8th, 2013 will be eligible for an immigrant VISA. I don't think that an application with a PD of Sep 8th,2013 would qualify to come under the cut off date today.

I really hope VB moves at least by a week. Have another friend of mine with a PD of Sep 10th.2013 .

No you are not a spoil sport. I have read the article and i fully understand now. Just like you, i have to hope that the cut-off-date moves at least by one week to be able to accommodate us.

Thanks again.

When did your I-130 petition reach the lockbox in Phoenix? Generally it is either that date or one or two days after that.

Guys, I have few concerns.

I got a checklist on october 17th regarding my I-864 The next day I mailed them a new one and they received it on 21st october and is in the system.

NVC has also received my IV documents on october 10 already and is in the system as well.

My concern is that, since the 1st checklist ,I have already received 3 checklist letters that says nothing but asks me to provide the Financial support document to be sent again which I already did on October 18th.

I am not sure why NVC keeps on sending me meaningless checklist cover letters.

Any one been through similar scenario?

Hi all.

Our priority date is September 4, 2013 and I called the USCIS today and they said I have to wait approximately 5 months to find out if our application can be approved or not? So, let's keep crossing our fingers, as we are constantly doing everyone going through this wait game.
