hi everyone on VJ! anyone here knows if I (beneficiary) can cancel the visa application? My fiance has been soo mean to me. I gave up a lot of things for him. I am a nurse and because he doesn't like my schedule he asked me to stop. I didn't want more fighting so i quit the job and try to be always available for him. But he never treated me fairly. He also didn't tell me that he was divorced four times. When i got sick, he accuses me of pretending and just seeking for attention( which is nonsense to me because he's not capable of taking care of me). I took a chance on him and he was just putting on a big faked when i met him. I came from a decent educated family and this guy visited me in Philippines and spent 90% of the time drinking, cussed me in front of my mom and my grandmother. I met this guy in Philippines last year and he seemed to be a perfect guy; now i know that he was just putting on a show and he's just looking for a new ex-wife. Our visa process is now close to the 5th month since NOA1. What should i do? i want to move on with my life and not stuck up with this visa thing because i know that he's not doing anything to cancel it even though i asked him to do so a million times!

If he will not cancel it and you want to go back to your country then just so. That will cancel the process.

Petitioner LPR upgraded to USC June 22, 2012
August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)

As the beneficiary you can stop the process at any point you wish. Just break up with him - if that is what you wish - and do not seek to continue the K-1 process any longer. If you receive any communication from the USCIS asking for documents, just send them a letter advising you are no longer seeking to immigrate to the US.

Good for you for seeing things clearly! Not disclosing the amount of divorces, use of bad language around family/friends, direspect to you, inability to support you, is reason to leave the situation immediately. You should never had quit your job but love makes us do crazy things, sometimes...

This is what I found:

"If you have not yet obtained the K-1, then simply do not apply for it at the US embassy. If you have already obtained it, then simply do not use it. A third option is to infom the DOS and USCIS that you no long wish to have a petition in process in which you are the beneficiary. This may be necessary if you decide at a later time to attempt to obtain another non-immigrant visa to the US."

Yeah if you've decided not to pursue then let it go to default. Don't response to any of request from the USEM. So sorry you have to go through all of this. Better you knew now than later on.

Sorry to hear this, but glad you found out before uprooting everything and moving to the US. Like others have said, there's nothing you need to do. Cut contact with him and don't go through with getting the visa at the US embassy once you get your NOA2 approval.

SOrry to hear this. From wehat I've learned about your country and its high ideals, I am sure this must have been very embarassing for you.

Hi Lucy,

It must be really hard to be in your shoes right now...My wife is a nurse and I know how hard the work is. ...However the silver line just maybe that you found this side of your fiance at this stage and not after marriage and immigrating to the US. I imagine it would be a lot harder to deal with then. Atleast now you can dump this guy and move on with your life. You can send NVC / USCIS an email that you will not be participating in the immigration process because you have broken up and then not respond to any other communication from them. This way, at a later stage if you do plan to immigrate, you can have a record of the email communication advising the NVC/USCIS of your withdrawal from the process.

Hi Lucy

Just email to US Consulate office in your area about your details such as; Case Number, Full Name, Passport Number, Petitioner Name from USA, and the NVC Receipt. And write them clearly you want to annulled this visa application from your end because of this reason. Please do not forget to write the reason.

This should be done in professional manner.

i agree with everyone else. break up with him and get on with your life. do not respond to anything from the embassy regarding the petition
