Just so you know....I wasn't trying to criticize your approach. And I'm by no means certain about the interview. It's just that after reading posts on VJ for the past couple years I had been under the assumption that the NBC would do 1 of 2 things...approve the GC or send it to the local office for an interview. If anyone knows of any other experiences, please share them.

So, I finally got a response from the Dallas USCIS office. It was a request to send in further information but the good thing I guess is that they are looking at it. Here's the bad news though.

I took my wife's last name when I moved over here and we got married. Just like most people taking their spouses name, I filed my paperwork under my new married name and supplied a certified copy of my marriage certificate. This same marriage certificate allowed me to get my SSN and my EAD from USCIS, as well as accounts through several financial institutions.

They have asked me to 'Furnish proof of my legal name change through a request to the county court'. I've read everywhere that the marriage certificate is 'proof' of a name change and the only time you need to do it via a county court is if you are an adult changing your name without getting married.

I think it is taking so long to work through cases because they haven't got a clue about what they are doing. Yet another show of incompetence on behalf of USCIS....as well as sending this request for information to my old address...despite it clearly stating on the USCIS case status site that my address was changed back in January.

Wow, nice of them to let you know they transferred it! If it was me, I would have tried to immediately call the KC field office directly and ask them A) if it has arrived yet and B) if so, what is the time estimate and C) does this mean we're having an Interview?

I thought that if it got transferred that meant you were going to get the interview letter, but I could be wrong.

My wife and I filed on Sept 21, 2012, so we're at about 9.5 months. Good to see some Sept. filers getting some action. I had always said if it went past 9 months I would start calling people, etc. but now I'm wondering if we should give it another couple weeks and just wait. And if I do decide to start "calling people" where should I start? USCIS? The NBC? Call my local office and ask them to look into it? All of the above?

Also, hang in there, looks like it is all happening at the 10 month time frame. Calling ain't going to do any good. Wait and lots of patience. There is no way you can speed this slow process. I can guarantee you that.

As for us, after almost 10 months of waiting, we got a letter from the mail today and it wasn't what we were expecting. My wife and I are very frustrated as we never got anything or any updates in our case until this letter. I called USCIS and they can't even give me further information and was just told that the last mail that was sent to us was the biometrics appointment last october. Online status is still in Acceptance. And now we suddenly got this. It is very frustrating. We'll be doing what the letter is asking for, and hope it goes ok from then. Has anyone experienced this before? The letter is as followed:

NOTICE OF INTENT TO DENY

This is your notification of the Service's intent to deny your Application to Register Permanent
Resident or Adjust Status (Form 1485) pursuant to 245 of the lmmigration and Nationality Act, as
amended (the Act).
Section 245 of the Act states in pertinent part:
The status of an alien who was inspected and admitted or paroled into the United States
or the status of any other alien having an approved petition for classification as a
VAWA self-petitioner may be adjusted by the Attorney General, in his discretion and
under such rigulations as he may prescribe, to that of an alien lawfully admitted for
permanent ..rid"r"" if (1) the alien makes an application for such adjustment, (2) the
alien is eligible to receive an immigrant visa and is admissible to the United States for
permanent residence, and (3) an immigrant visa is immediately available to him at the

291 of the Act, the burden of proof is on the applicant to establish the eligibilif for the benefit sought.
Please comply with the following:

Please submit evidence you are current for age specific immunization. Please submit a properly
completed Form l-693,Report of Medical Examination and Vaccination Record. The medical
examination section does not need to be completed, but the vaccination record must be completed by
a civil surgeon who has been designated by USCIS.
The Vaccination Record (documentation of immunization) is documented by completion of:
. Part 1,
. Part 3, and
. The Vaccination Record.
To obtain names and telephone numbers of the designated civil surgeons in your ilrea, go online to
http://www.uscis.gov/ or call USCIS'National Customer Service Center at l-800-375-5283. You
may need to provide your zip code. Have a pen or pencil ready to write down the list of civil
surgeons in your area.
The civil surgeon must conduct the exam as directed in the instructions to Form I-693 and in the
Centers for Disease Control's Technical Instructions for the Medical Examination of Aliens in the
United States. Both the medical examination and the vaccination record must be completed when
required.
Please note that the fomr must be sealed in an envelope by your examining physician. The unopened
envelope should be retumed to U.S. Citizenship and Lnmigration Services (USCIS).

Submit a completed Form G-325A (Biographic Information sheet)

In accordance with 8 CFR $ 103.2(b), you are hereby given thirty (30) days from the date of this
letter to inspect the evidence in this case and offer written evidence in rebuttal. If you submit a
document in any language other than English, you must include the English translation. The
translator must certify that the translation is accurate and that he or she is competent to translate. If
no explanation, rebuttal, or evidence is received within the time given, the case will be decided on
the present evidence.

Looks like you need to send:

Form l-693 - Did you provide a copy of the 3025? If so, guess it was lost at USCIS and it's not the 1st time this happens... You have to quickly get a list of approved Civil Surgeon doctors in your area. Start calling and find the cheapest price. Do you have the Form 3025? Take this with you. Most likely, your overseas doctor paperwork has expired.

Need page 1 and the vaccinations page of the I-693 filled out by the Civil Surgeon. Take the shot records with you to the Civil Surgeon. The required vaccinations for AOS are, MMR, Tdap/TD, varicella(or history of chickenpox), and flu shot (only during flu season- Oct. - Mar.)

so sad to hear about this..btw, how many months does it takes you guys before you were able to file the adjustment of status..because i know some other people that they submit their AOS w/o the immunization but they didn't encounter such problem..

I just came back from my local Hialeah, Florida immigration office (infopass) , they are so Slow and they are unable to find my file ( i hope they didn't LOST it ), after waiting 1 hours lady called me and goes that your file is in our officae we got it on june-15-2013 and hopefully you will get any information or interview lwtter in two weeks after waiting 10 months and 2 weeks ( thats stupid). So i have to wait twoo week to make sure that they find my file and after that i will have interview. There officers are not working on friday. i dont understand why immigration officaer do not work on friday.? so my field office work only 4 days a week and friday till sundau they have holidays.? WORST immigration office.

We are also among the September Filers & our case should be processed from the Atlanta Field office (if it actually made it there).

Just called USCIS & since its outside of the normal processing time they have made a request for us to receive an update within 2 weeks.

On the other hand the CSR mentioned that Atlanta is already processing I-485 from November 8th - I'm a little bit concerned? Anyone else facing a similar situation?

One of our biggest concerns is that any communication from USCIS getting lost in the mail, checked with the CSR & he mentioned that he did not see any activity on the case except for the initial case acceptance - can they really see this on their end or was it more to just get done with the conversation. We have been diligently checking the mail & emails - so far no update.

We received the EAD / AP around November itself.

Do you know when it got transferred to the field office? Once ours got sent to the local office our approval came not too long after that. It was sent 2 days after our congressman inquired. If it is at your local office i would think you should hear something soon!
