Conditional GC and wants a divorce

Hey all,

A friend of mine got married to a USC late last year. She did the AOS and got her GC a few months ago. Her husband is very controlling and demanding. He quit his job and choose not to work, he wants her to take care of him and every bills in the household. She goes to school fulltime and currently working a full time job. With her husband not working, she's now forced to find a part time job just to keep up with the bills. She's so stressed out to the point where she can't focus on her classes. Her husband stays at home or hang out with friends everyday all day. She even think that he's cheating because she would go home from work and find long blond hair in their bed. Long story short. She wants a divorce but she's scared of the outcome when it comes to immigration. Will she be able to get a 10 yrs GC if she divorce her husband?

Any help would be greatly appreciated

Yup. If ya study the ROC form, there's a tickbox for that.

Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

She can still do her ROC, she will need some strong letters from friends, etc... verifying that they were witnesses to the marriage.

FYI, there are certain people on here you will learn to ignore their responds. Always ignorant and negative! C'est la vie!

As long as she can show that they had/have a bona fide marital relationship (not a sham done for immigration only) she can remove the conditions on the green card after the divorce.

Hopefully the bills are in both of their names and maybe the bank statements, car insurance. It would also help if she had some receipts if they took some trips together. Good luck to your friend.

09/22/09: NOA2

10/05/09: Received case# and gave emails

10/07/09: Received DS-3032 and AOS email

10/09/09: Sent DS-3032 email to optin electronic filing

10/15/09: Paid both AOS & IV fees

10/16/09: Received email electronic filing accepted

10/18/09: Sent AOS via email

10/23/09: Received email that AOS was accepted and waiting for IV

10/27/09: Sent IV via email

11/10/09: Signon to payment failure

11/19/09: Received email for interview - December 14th

12/14/09: Approved for Visa

Gowon may have a legitimate point. It is understandable that, if your friend is unfamiliar with the immigration process and asks you a question, you would simply want to seek an answer on her behalf regarding adjusting her status in the event of a divorce. However, outside of answering a question for her, getting into the middle of a friend's marriage (and potential divorce) is advisably not a good place to be. Going into details of your friend's life and how horrible her husband is may have led Gowon to believe that was the direction you were headed. Take it from people who have gone through a divorce (of which I infer Gowon has), it is very ugly and not a decision you should make yourself too big a part of in your friend's life.

You may not appreciate my response either, and I respect that. I am just trying to provide some perspective to Gowon's question. (Of course, I may stand corrected.)
