Hello everyone. I have a question. I am currently submitting a K1 Visa petition and I am wondering if I can expect problems because I currently hold a TS (Top Secret Clearance) for my Job. Does anyone have any experience or advice then can give me in a situation like this? My Fiance is Chinese. We intend on being completely honest about everything. Will we be denied because I hold a TS clearance? Is it possible I can loose my Job? Thanks again for the expert advice =)

As you know, a TS review could cause you to have questionable approval. You are required to update your security manager of any changes that could be of concern for national security. I would go to that person and ask them how it will impact you and your TS clearance. If I were the SM I would remove the TSC from you until a review could be completed.

No Holding a clearance is a matter of demonstrating that you are not subject to undue influence from negative sources. Although the internet in general may be a negative source I doubt he is any more likely to spill his guts just because you all know he is cleared. Sometimes just knowing a place of employment implues a higher level clearance.

This will not be over quickly. You will not enjoy this.

Sorry, typo. It's my TS/SCI that I will be losing once I completed my K-1 visa for my fiancee and updated my clearance.

Why would u lose a clearance for applying for a visa? This makes no sense, for a a TS clearance they go back 10 years for a S clearance its 7,,,y would u lose that for preparing to marry someone and applying a non immigrant visa?

So you will be loosing your SCI but not your complete TS correct?

I obtained mine through private contractor for DOD and my SO (security officer) already informed me that I won't be able to maintain them by virtue of marrying/sponsoring a foreign national. That's for both TS and SCI. Whether or not you may be able to maintain your TS is up to adjudication authorities and depending if you are currently serving in the military, or work for the other named acronyms (DOE, DOS, DHS or DIA)or in IC (definitely will deny to keep). The private contractor that I am with is following the protocol with its contract with DOD, thus they have pulled my access.

As far as I know, co-habitation or marriage to foreign national from "certain nations" will almost result in the loss of clearance for both TS and SCI. In your case, you need to ask your SO or you may already required to inform your SO by having a fiancee from PRoC. You will need to list all her family members on your SF-86. The real question to ask yourself is that can you still do you job without TS Clearance should you get deny to keep it?

Yes - I cannot do my Job with out clearance. SCI/TS and TS/collateral(the clearance I have) have very different criterion for foreign influence. I agree that I would loose my clearance for SCI (unless a waiver was given because your specific skills are needed) but a TS should not be too much of a problem according to the the experts at http://www.clearancejobs.com/news.php?articleID=54. If my contract has a specific requirement that all employees have zero foreign influence then I agree I would have a problem. The idea that certain nations will result in an automatic loss of clearance for TS is not true because all nations are treated with the same amount of seriousness under our law. Certainly OTHER factors will and can contribute whether I can keep my clearance but country alone is certainly not the biggest factor.

You did not state if your clearance is civilian or military. If it is military you will temporarily lose it if you did not get permission to marry a foreign national prior to filing petition. Been through that already. Mine was revoked for 6 months while they did a background check on my wife. I was well above a basic TS. You need to speak to our security officer and they will tell you. Mine was revoked for marrying a filipino so I can only imagine marrying someone from China.

I have a civilian TS clearance. They take all countries under equal consideration under the law but no question USA interactions with China's government are certainly a major concern. So after your 6 months they revoked your clearance?

Your TS should be intact, provided you have been following the rules with receiving permission to travel to china and filling out the required travel debrief when you returned. Most likely on your re-investigation you will be sent to adjudication, and a good chance you will not be re-issued a TS since your wife is from China. However there are a lot of factors and that depends on your program. Lots of high profile Chinese espionage cases in the past few years.

I do have some experience with this (not with China though), my SFO said I had no issues also, however won't detail it on a public forum.
