As a beneficiary of a k1 visa, the first month is all fun, but then you start filling frustrated cause I cant work or drive. My husband bought me a car but i cannot drive it yet. During the week, I spend a lot of time alone cause my husband is working 8 hrs at day. I get bored very often! All I can wait is getting my EAD and my Driver license. When you are in this positition you become pretty dependent of your partner. Not only that but also, he will be missing his family and friends, his old life.Im not trying to scare you, but is a reality and the only way to be out of it as soon as possible is getting his AoS ASAP Hope you take the best desition

As long as you marry within 90 days period, you are fine. But, don't ever take the risk. If you are sure of marrying, don't ever wait for last minute. You never know what could happen -- Best wishes ! :)

I suggest you read the papers you're signing before your interview to understand the "contract" between USCIS and you. USCIS isn't flexible with being married after the 90 day. If something goes wrong and you marry one day later than that, you MAY submit AOS along with i-130 but that is a more expensive process

When your visa is issued and in passport, look at the expiration date. You have to enter the US before that date. I'd suggest postponing your POE a little rather than getting married on day 90. This also means that you are in the US for less time before filing AOS, and hopefully your overall time until having work permit is down. 90 days is a long time without a job when your fiance has to feed a person more and save for AOS at the same time.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

Why put yourself in such a situation with less than a week to file whatever paperwork may be needed to prove your marriage? I just do not see any logical reason for doing so. I would marry at least 14 days before the deadline at the latest, but that is me.

i jst have a question,, when i get there in the US can we marry at exactly 90 days of my stay? on my 90th day we will marry? or like 85th day? coz we have to adjust our status right? would it be alright to marry on 90th or 85 because we want to save money first before we get marry.. is this going to be a problem or no?

This is really very simple. Your K1 visa has an expiration date (usually six months from your medical). You have to ENTER the United States before that date.

Once you are here, you K1 visa is used up, and you will be issued an I-94..

IT will have an expiration date 90 days from the day you entered. You must marry before that I-94 expires. So you could get married on Day 2, or Day 10, or Day 89! It's totally up to you.

The adjustment of status does not need to be filed within that 90 days, although some people choose to do so, others wait many months to file it.

I suppose getting married ON the 90th day would still be legal, but as others have noted, WHY would you risk pushing it so late? What if the priest gets very sick and can't perform. What if a storm blows over the church.

Getting married around day 60 is what we're planning, that gives us two months to plan something, and then still plenty of time not to risk anything.

Maybe her opinion but still the is the IO. Never wait till the 9th hour when the government is involved.

If you do not get married within those 90 days, you will not be able to stay in the US and get the Green Card. So make very sure that there are no problems. Waiting until the last day is risky.

You seem angey for no reason. I dont think the woman is a stupid, it just sounds like she thinks its best to do it that way, probably makes everything easier for everyone. She didnt say it was the law or requirement. Kind of like your teacher gives you an assignment that is due in 30 days and you turn it in the 20th day and they say you were smart for turning it in early. Doesnt mean someone who turns it in on the 30th day is wrong/incorrect.
