What happens if my Fiance is pregnant? I have just sent in our I-129f application after coming back to the US two weeks earlier. One of my questions is, will they count the unborn baby as an additional family member? I want to be prepared if they will require me to be in the next level for the financial support.

They only count a baby who has been born before the interview.

I think you are required to inform consulate that you know this issue and will be still willing to continue the VISA application, maybe you want to inform the department in the US too. if the child is borned before interview, the child will have K2 visa. :blush:

I do not believe a visa can be issued to a child that has a claim to US citizenship.

The child is not borned in the US, he will not be a US citizen automatically. If two parents are from different countries, the child will be able to choose his nationality when he is 18. I know this works when the child is borned in the US, BUT I dont know about other countries, we all know they might have different policy. In this case, even if the child is borned in the US, he can still choose not to be a US citizen because of his parents's nationalities.

I do not believe a visa can be issued to a child that has a claim to US citizenship.

That is incorrect. In this circumstance the US citizen parent will file a CRBA Consular Report of Birth Abroad at the embassy where the child is born to obtain a US passport for the child. The child cannot be issued a visa.

The child is a US citizen when born. If the parents want to bring the child to the US it is done with a US passport. No visa can be issued to a person with claims to US citizenship.

Well, first of all, she gives birth within 9 months. :D Congrats!

Beware that some won't let a pregnant woman(depending on how far along she is) fly/board a plane. You'll have to time that one, just keep it in mind. You'll need a CRBA if the kiddo is born overseas. Since the kid has claim to US citizenship(assuming you're the father), then they're not eligible for a visa.

Child born before interview: Add to household size, get CRBA

Child born after interview, before POE: get CRBA

Regardless, it's a extra dependant when it comes to AOS.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
