I HAVE A SITUATION HERE AND IM JUST LOOKING TO HEAR OTHER PEOPLES THOUGHTS.FOR THE PAST 3 AND A HALF YEARS I HAVE BEEN WORKING ON MY K1 VISA WITH MY FIANCE.WITH LITTLE HELP FROM HER.OVER THE 3 AND A HALF YEARS I HAVE HELPED HER OUT WITH MANY THINGSAND I HAVE VISITED HER A FEW TIMES. SO 2 MONTHS AGO SHE HAD HER INTERVIEW AT THE EMBASSY, A MONTH AGO SHE SAYS SHE FINALLY GOT HER VISA.AND WE WERE SO HAPPY AT THE MOMENT.SO ONCE SHE GOT THE VISA I SKED HER WHENS THE DATE SHE WANTS TO COME.SHE KEPT SAYING AS SOON AS HER MOTHER LEAVES BECAUSE HER MOM HAD CAME TO KENYA TO VISIT HER. I SENT HER MONEY TO GET A AIRLINE TICKET.I THEN FOUND A REALLY NICE DEAL FOR A TICKET BUT SHE REFUSED TO BUY THE TICKET SHE SAID THAT SHE WILL LOOK FOR A BETTER DEAL.I FOUND A TICKET FROM KENYA TO CHICAGO FOR $1060.SO FOR THE PAST 2 WEEKS I HAD LITTLE TO NO CONTACT WITH HER,SHE KEPT BLOWING ME OFF NO PHONE CALLS SHE SAYS SHE LOST HER PHONE AND THEN SHE WAS SUPPOSED TO MEET ME ON YM AND SHE NEVER DID.SO I FINALLY GOT IN TOUCH WITH HER ON APRIL 6 SHE SAYS SHE WILL BE COMING 3 DAYS FROM APRIL 7.I SAID OK I WAS SO HAPPY BUT THEN SHE SAYS SHE WILL GO TO WASHINGTON DC TO VISIT HER BROTHER UNTIL THE TIME WE GET MARRIED.SO IM VERY CONFUSED NOW BECAUSE IM STILL NOT REALLY BEEN IN CONTACT TO HER.ITS APRIL 10 NOW AND I NOT KNOW WHERE SHE IS YET.NO CALL NO NOTHING.WE ONLY HAVE 90 DAYS TO MARRY WE DONT HAVE MUCH TIME.I CALLED HER BROTHER HE SAYS HE AGREE WITH ME HE DOESNT KNOW WHY SHE NOT COMING TO ME.I THOUGHT THIS IS SUPPOSED TO BE A JOYOUS TIME INSTEAD ITS A HEADACHE THAT DOESNT NEED TO BE ONE.I WOULD OF LOVED TO BEEN THE FIRST PERSON SHE WOULD WANT TO SEE AFTER SO LONG. SO WHAT DO YOU ALL THINK?

Were you sending her regular money before the interview?

If so, then it may be that she never went to the interview or has no real intentions to come to the US and may just never use the visa.

We have seen this type of scam before, especially if you were regularly sending money....usually the woman also is doing this to other men at the same time. For each it was a modest sum of regular money being sent but all added up to a nice income.

If she comes to the US, then this all goes away.

Of it could be she is very scared to come and you need to prepare her for her new life here.

I think you just gave her a free ticket to the U.S. If she wants to be with her brother more than you, I am sorry to say, you have a very big problem on your hands. And do not be surprised if her brother is in on this game she is playing.

She cannot legally marry any one else except you, as this would be fraud. After her 90 days are up, she is now here illegally.

A definite possibility. Do you know if she even went to the embassy to get a visa.?

Something is definitely wrong here...wayyyyy wrong. I am sorry you are going through this. If I didn't hear from my Fiance after all of that, no phone call, nothing....I'd be on the plane to Kenya to kick his a$$. This isn't good. I would get to the bottom of it real quick...REAL quick.

That's a good point because the Nairobi Embassy is really tough so whose to even say they granted her the visa??? This is just all wrong.

You should be able to find out the status of your petition and if she received one. I personally think she never got a Visa. What of the money you sent you ever got an answer about that. Sorry that you were taken. But 3 1/2 years were there signs? And if I were you if she doesn't return calls I would stop her VISA so she is stopped at POE if she got a VISA. If thats possible.

Wow, I agree with the other posters, this looks very suspicious. I am leaning towards the theory that she just wanted a "ticket" to come to the US and her brother is helping her. She probably had/has no intention to marry you. As suggested above you can inquire about it, call DOS and find out if a visa was granted, then take it from there. Good Luck.

Call DOS first, and the embassy if necessary, to find out what truly happened.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Very suspicious! Appears that either, she is trying to only come to US but not marry you or never received a visa in the first place and took you for your money. You definitely should have been more involved in the process becuase you would know the true status of your case. Also, Kenya is a challenging embassy and theey do not give visas lightly. If she actually recived a visa, trust me she would have had alot to talk about because that is an experience, all in itself! Also, with the limited visits you mention, I find it hard to believe that the consular, would not have requested an overwhelming amount of proof as well as ask why the petitoner is not present.

I agree with all of the above posters for she might just be running a scam on you and other men at the same time! Contact the embassy and let them know you are the petitioner and inquire about the status of the visa. You need to look into this asap before you have more problems to deal with later on.

Additionally,in my opinion only, spouses who have family and friends residing in the US, seem to many times want to only obtain a visa to the US by any means necessary (you). They have options, once they arrive and know very well how to beat the system. Especially, those who have the ability to obtain legal advice/consul and financial resources through their connections on this side. It appears you will be in for long spin, if she comes.
