Hello everyone. My fiance left the army last year and is now in college. He is currently not working but he gets financial aid from the military. I will have my interview soon and we are worried about the documents I should present if they ask about his financial capability to support. He has filed his taxes recently and still meets the requirement for k1-visa, however this may not be enough to convince them. Aside from the tax transcripts and form I-134,any other papers we need? For the tax transcripts, does it have to be the past three years? Can we just submit the latest transcript? Do we have to prove he is a full-time student now?

Iff he's not getting a salary. He needs a sponsor before the interview. If you are employed and your earnings is more than the poverty guidelines, you can use that as household income or show assets that will indicate you will not become a ward of the state. Bottom line is, you guys have to prove financial independence or support from a friend or family member.

Yes the requirement is that he has to file taxes for the past three years if he is the only support financially. However, if he hasn't, he will need a sponsor. He will have to write a letter giving reasons for his infield years. .

In my case my husband just went reserved in the army and went to school so he just wrote a statement about his situation that he is in school to earn a degree or whatever and simply going to school to improved himself and increase the income to support me and our future family. And explain in the letter the hi mom is prepared to co-sponsor if needed, So I have her moms paperwork ready just incase they will ask for it but they didnt. And we only submitted the latest Form 1040 and W-2 and have the past 2 years ready for back-up. Submitted the letter from the army stating his status. THen wrote another letter to explain all his school information and the funding he is receiving from the army for school and enclosed several documents with the letter like the PELL GRANT and G.I Bill statement.

So I hope it helps and give you some idea. I didnt have problem at all on my interview I wan even never ask about all the documents. We we're talking non-related stuff :)

Thanks for your reply. I'm not sure if we can get a sponsor. It might be too late for that already.We can only show past three years of tax transcripts including 2011. This is kinda frustrating. :(

Hi, thanks for your attention. This is for K-1 interview. We are worried that they would question about him being unemployed at the moment. He left the army in June of last yr. However, the army still pays for his school fees and apartment and he gets sort of like allowance. I'm not sure what is that called. I don;t know what can we bring in the intervew to prove that he can support.

Thats what I showed to the CO in Manila Embassy and I didn't have problem and he was even thankful for the letter but I wish it will go easy for you on your interview day! Good Luck! if you have more questions you can message me :)

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
