Chances of Being Denied?

Hi everyone!

My fiance and I submitted our initial K-1 application just yesterday (he's the petitioner, I'm the beneficiery) ... and horror of horrors, we see the (very helpful, but all too late for us) checklist on this website a few hours later. We are completely panicking! There are two things we did not do:

1. Didn't write the date, names, and locations on the backs of the photos

2. Didn't sign and date the Question 18 Supplement: Explanation of meeting in person

Like I said, we are FREAKING OUT. When I read that checklist I wanted to cry. So the question is... what do you think the chances are that they will deny our application? How majorly important are those two details? And if they do deny it, when will it happen? Before the NOA1 or will it take as long as the NOA2 to be informed?

And most importantly, will they keep the filing fee? $340 is A LOT of money for us right now, it will be devastating if we have to do everything over and come up with the money again.

We greatly appreciation any opinions or advice.

I can't say for sure, but I believe that you will just receive an RFE requesting more information. Unless there are a lot of errors in the application you sent off. I don't think they would deny the application based on that alone, in which case you shouldn't have to pay another $340 to start again. However if you do get an RFE then it will delay your application a little until whenever you are able to submit the information that they require.

If I'm wrong on this, please correct me!

Agree on that with Ezekiel Chester.

But have you submitted any other evidence of meeting in person besides pictures. Pictures by itself will not be sufficient. You really want to show evidence like visa copies, entry/exit stamps, hotel reciept etc...

Yes, we sent photocopies of all my airline tickets, arrival and return (4 visits total). We did not have any hotel receipts and for Canadians travelling to and from the US they do not stamp your passport.

As long as they can establish that you two have met you should have no problems.

Interesting I am a US Citizen and I got stamped everytime I visit Canada.

Hmm, very weird. Wish they did because I love having lots of stamps in my passport. I've probably been to the states 10+ times on this passport (not just to visit him) and I've never had it stamped.

Yeah I've noticed that!! When I travelled from the US in to Canada, they stamped my passport! But not when I came across from Canada to the US! I just figured it was because i'm British! haha!

Just to chime in based on my K1 experience. I did not sign and date photos either, but they were backed up by visit info (ticket stubs, hotel bills). So that's not a big deal. The missed signature on that form will likely trigger an RFE. But it's not the end of the world. They'll send anything back for signatures or other corrections. It's just a delay, but if there are too many issues, it may bring closer scrutiny. We had an RFE for some more details, which I provided, and it still moved on to eventual approval. So just go with the flow and best of luck to you!

Good Luck, FYI triple read and reread everything including the instructions. RFE can cause lots of time delays, you don't want. Hang in there.

1. Neither did I. Approved without RFE

2. I didn't do a supplement for Qn 18 but I DID do supplements for the residence and employment for the G-325A and neither of those pages had my signature. Approved without RFE.

I will also mention I did the same thing for my AOS G-325A and also approved without RFE or interview.

I would not be freaking out if I were you. In the event they want it they'll RFE you which WILL slow you down but doesn't mean you repay the fee or anything so it's not the end of the world. Seriously. Don't stress. Neither of those are big deals.

For people who will be dealing with tough consulates (which Canada's are not), getting an RFE (Request For Evidence, in VJ parlance) can be a blessing in disguise, if not an outright boon. Besides responding to the RFE, you can include further evidence of an ongoing bona fide relationship. A couple on here who will be inflicted upon by the ####### Guayaquil consulate (Ecuador) just got an RFE, and they could almost hear my cheers from afar at their glorious opportunity to add material that the consulate will eventually see.

USCIS doesn't care about this kind of extra information, but they pass everything that they receive to the consulate, where it can make quite a difference.

Not a problem. We sent only one photo with no names and dates on it and we wrote the answer to question 18 in the space provided, can you imagine???!!! So guess what? I did not sign and date the answer to question 18 either!

The VJ checklist tends to be a bit over conservative, not a bad thing unless you think that every small detail is worth freaking out over. It isn't.

Having names on photos is important ONLY in case your photos get separated from your file, we will hope that does not happen. Same with having your NAMES and a description of what you are answering, signature not needed. It is not a document it is an answer to a question, no need for a signature on every answer.

Worst case, you would not "lose" your fee, you would get an RFE and then provide what was missing. Your signature on the form I-129f suffices.

Now if you keep checking on your petition AFTER you sent it, instead of BEFORE you sent it, I am sure you can find something else to freak out about, but it would be a waste of time. If everything is OK, you will be approved, if not you will get an RFE and send in what they want. Nothing to freak out about. Since you have already sent the petition I suggest you put your copy in a safe place and leave it there.
