I filed I-129f last week, but I still haven't received the text or any notification of receipt. I'm aware this may take some time. My fiance and I are discussing getting married NOW rather than waiting for him to come here on the K1 visa. Which means I would go to his country and we get married (as soon as 3 weeks from now). If we go this route, I'd then have to file the I130 form.

Has anyone ever done this? What are the implications for doing this? I want my baby here as quickly as possible! I know either one takes time, but just wanted to know which is better. Financially, it appears the I130 is less money in the long run (no need to pay for work permit application is one example).

Any help and input would be appreciated. Thanks!

The first thing is that you would lose the filing fees you have already paid and have to pay again for the new petition.

The K1 visa is generally finished a bit quicker than the IR1/CR1 but it's not a significant difference at the moment. The main advantage of the IR1/CR1 in my opinion is that your spouse would enter as a permanent resident and receive a green card immediately so he would be able to work straight away and travel abroad if necessary. With the K1 you would need to marry within 90 days of his arrival and then file for AOS with another hefty fee.

You can marry, and change visa paths from K-1 to IR-1/CR-1, it has been done before and will likely happen again, as affairs of the heart go. Realize that you will abandon your K-1 petition, forfeit any fees that you have already paid, and start all over again on the Ir-1/CR-1 process.

Thanks for your responses.

It appears that the I-130 is definitely the best alternative, even if I've thrown away $340 already. In the long-run, the I-129f process fees (for the I-765 and I-485) would total about $1,790 while the I-130 would be around $420 plus the $340 donation that I've already given to the government for the I-129f. Not that the financial is an issue, but overall it appears to be less headache after he arrives in the states. There would be no need to adjust status or apply for work permit.

There is also a "visa fee" and Affidavit of Support Fee you are missing in your calculation. There are more fees than just the I-130 for a spousal visa. Probably still cheaper than K-1, but your calculations are missing some things.

It is definitely less expensive to do the CR1 and in my observation, the CR1 is MUCH better in terms of the stress level once they get here. Too bad ya'll did not have this discussion last week before you sent the fiance petition :bonk: Could you stop payment on the check?

I wouldn't recommend stopping payment on that check. Just consider it a donation to the government.

No problem. Get married, withdraw the I-129f and file an I-130. You lose what you paid and pay a new fee for the I-130. No big deal.

Just to consider, not sure about Jamica, but other countries can become a process to complete. ie, trips to embassy or permission to marry from us embassy or waiting period after application, translation of documents...?????? Just to look into and consider...

Have you looked at the process / time needed for foreign national to marry citizen in Jamica? Just to consider, not sure about Jamica, but other countries can become a process to complete. ie, trips to embassy or permission to marry from us embassy or waiting period after application, translation of documents...?????? Just to look into and consider...

Just did a quick google search, and Jamica seems quite easy compared to others i've seen... let us know what you deceide.

Thanks all.. I called USCIS today to find out if I had any options. I was told that I can send a letter to the processing center my case gets assigned to and request for it to be withdrawn. Something she said though seemed conflicting.... She said the I-129f takes a shorter time period because it doesn't have to go to the NVC, instead it goes directly to the foreign consulate. She was therefore saying that lessens the time period because of the direct transfer to the consulate. Was she giving me wrong information/

In a way yes and in a way no. The paperwork still goes to NVC and NVC forwards it to the consulate, however, when i called NVC they told me they only do minimal processing for K-1 Visas and everything is supposed to get forwarded within 72 hours of input into their system. Doesn't always work out that way, but then again more often then not that is just how it is.

You should be betting your noa1 in the mail in a few days. You aredoing a k1 for Jamaica,most of the members I have seen have not waited very long. Good luck with whatever you decide
