i just read e mail from lawyer to my wife in usa saying that :

I have learned that the USCIS California Service Center is now processing spousal I-130 cases that were filed prior to August 2, 2011.

Mario’s priority date is September 6, 2011.

Mario is one month away from having his case adjudicated.

Immigration does not consider his case processing to be delayed.

I have carefully reviewed the documents that you provided my office to request an expedite based on your medical problems related to your emotional state.

I do not think that presenting you as an emotionally disabled petitioner this early in the process is worth justifying a request to have your case adjudicated three or four weeks earlier.

I ask that you trust my judgment in this matter.

Getting an expedite on these grounds could result in a real delay in Mario’s case at the National Visa Center or consulate level which would be self-defeating.

Hope this helps to clarify where you are in this administrative process.

i would suggest you ask your wife's input for any translation of that email.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

He's basically saying what the USCIS would tell you. USCIS is seriously backlogged, and taking about 6 months to process I-130 petitions. They don't care if you are suffering emotionally, it does not give grounds for expedite. We're all suffering emotionally :( If emotional suffering qualified for an expedite, 95% of petitions would be expedited, and the expediate process would be just as slow as the regular process.

I think your lawyer is doing his job and giving you good advise here. Thank him. Asking for an expedite at this stage, and not getting the expedite, may actually delay the process.

As far as timing, it's all in the hands of the USCIS, there is nothing you, your wife, your lawyer or any lawyer can do to speed it up.

My advise to you is:

1. Expect the petition to be approved at some point in March.

2. Begin to work with your lawyer on the NVC stage. That way, when your petition is approved, you'll be well prepared, and the NVC stage will be quicker.

3. Remember that we are over 100,000 petitioners wanting to be with our husbands and wives ASAP.. All waiting for the USCIS to adjudicate our petitions.

4. Remember that while the process is slow, your petition will be adjudicated.

since you hired a lawyer, its best to let them do their jobs.. we really couldnt control much of how the USCIS process works.. you can anyway update urself by checking on the website... they process papers according to priority dates and if they wud approve expedite, it should be of valid reasons..

its not only u who's experiencing such delays.. a lot from my home country too is...

INTERVIEW DATE = January 6, 2012 = APPROVED!!! ----Our interview took 250 days from our I-130 NOA1 date.

VISA PRODUCTION = January 6,2012

VISA DELIVERY = January 11, 2012

POE = Feb.18, 2012

SSN Received = Feb 25, 2012

GC received = April 5, 2012 (incorrect data entry :((, sent back April 9, 2012)

CORRECT GC RECEIVED = August 22, 2012, granted IR1 (10 year gc)

that's where our USCIS process ends for now.. will wait for the next 3-4 years what we'll do next...

Your lawyer is doing his job well. If you were to get an expedite based on a medical reason it would have to be an extreme emergent situation.. Like cancer.

He doesn't believe that it qualifies as extreme hardship IMO.

You were already in that position before petitioning(emails 2 weeks after submitting paperwork). When the situation hasn't changed or it's not an extreme hardship, there's no foundation for an expedite. Having proof of being emotionally disabled might help you but not if your lawyer refuses, and not when it's more than common that it takes its toll on most couples to be apart through this process. I'm sorry, hope time will fly by.

He means you wait. There is nothing else to do now. We have all been through this wait for varying lengths of time.

The lawyer is also saying that to claim the US Citizen spouse has severe enough emotional problems to rush the case, would cause problems with the issue of the visa. If your spouse is emotionally unstable, perhaps the relationship she has with you is based on unstable emotions, making it less genuine.

You wait. You don't like it, but you wait.

I have been waiting 6 months by today so dont worry nothing is wrong with your case.. and I am also going through emotional breakdown but everyone else is too so they cant really do anything with our cases :( I hope its not long from now though...

Folks people from Brazil (my home Country) are waiting 1 year to have their I-130 approved, they would be very happy to exchange place with someone waiting just 6months.

I do not know who those brazil people are but here are the stats from VJ. The longest I seen is 6 months and many others are less than 2 months. Maybe you should fill out your timeline to give us more accurate data?

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Actually, know what? I'm from Canada, my timeline is updated, we've been in touch with CSC and congressmen, we found out the same information you did - CSC is backed up - and our petition is at almost 6 months. Looking like at least two more weeks, too. Waiting is not the end of the world if you're really in love. Seriously - if you know it's real love, you'll do whatever it takes to get there, right? Well, sometimes that means waiting. It kind of sucks but what can you do - besides more paperwork?

NVC (30 days, March 12 to April 11. Case expedited due to NVC errors).

Montreal US Consulate, awaiting interview date (14 days, April 12 to April 26).
