Well I am always saying that I am about to send my AOS package..

But the more I ask and I check the more things I find to do..

But today I think I have everything ready to send.

Please can you tell me if I am forgetting anything??

My cover letter looked pretty much like yours. I even added blank colored pages as dividers between them and had to buy huge paper clips.

I think amble is right, they do have to submit Form I-130. When I send my package I consult the guide lines here at vjourney (My link) and an Immigration lawyer to check the forms that I was going to send and the FORM I-130 needs to be included.

If they don't send that form your case might get delay because they are going to send a Request for further Information.

So if you go to the link I posted, my advice would be to add Form I-130.

The OP does NOT need a I-130. They entered the US with a K-1 visa and married within the 90 days. They are not adjusting from a non-immigrant visa like the two people that responded. Please note this forum is "AOS from family-based visas." The process here is different than the OP's.

I have a friend of Mine who entered the United States with a K-1 visa and when she applied for Adjustment of status she had to send FORM I-130, because know they are asking for a change of status which is based know on FAMILY. Here is a link from USCIS My link and they ask you in what category you believe best fits your situation, in most cases, you will need to have an immigrant petition filed on your behalf. The only category are: Family Based, Employment Based, Special classes of immigrant aND Humanitarian Based.

In this case they fall in the Family based category, which require to send a Form I - 130. The process they did befor was for that person to obtain a K-1 Visa, that process is over. Know the process is an Adjustment of Status, a whole new process.

I just read the Instruction Guide of Form I-485 in the USCIS webpage and in page #5, left column on the very bottom it says that if the Form- I -130 had been approved send a copy of it, if not they would need to submit Form I 130. I don't know I might misunderstood what I read. But maybe you are right and there is no need to submit that form.

I did, but that is in the form and it is ok to check that choice c, but in the instructions guide go to page #5 and read from where it says: Where should you File Form I-485. They give an advice of how to filled and mentioned what I just wrote on my previous post.

There's no need to be petitioned again. Just adjust. Send a copy of the I-130 approval notice. She only needs one G 1145 and it should be attached to the front of the first document. You will get individual responses for each application.

When adjusting from a K-1, there is no need for an I-130. Read page 4, #12 B. of the I-485 instructions. You only have to send in a copy of your approval notice from the I-129F petition (NOA2), copy of your I-94 and copy of your marriage certificate.

The guide here on VJ for adjusting status from a K-1 lists all the documents required. The OP is good to go.

So if you go to the link I posted, my advice would be to add Form I-130.

You might *think* amble is right but you would be wrong thinking so. A K1 doesn't need an I-130 unless they married after the 90 days, or they AOS after they've been married for 2 years.

I know this for sure because:

1. The instructions state it

2. I entered on a K1

3. I AOS'd without an I-130 as did thousands of other K1 entrants.

Filing an I-130 when it's not required is not only a waste of money but has been known to delay the process by at least a year.
