Hi Everyone:

I am colleting all the documents for AOS..

But we are not sending the Travel and Employment Authorization application..because I am not planing on going to visit my family til maybe after September 2012.

I was wondering how long is the process if you apply being a k-1 visa holder??

If my case is in process for a long time and I want to travel.. can I apply to get a travel document even if I didn't send the form I-131 with all the AOS packet?

I have another question regarding to school and my driver license.. I got a driver license as soon as I got here, which now is expired, can I renew it with the letter they send after they get my AOS packet..and can i apply with the same letter to start school???

Thanks

yes you can apply separately, but its better to do it all at once because they waive the fees when you file all together. You realize you cannot work without the EAD right? it can take up to two years for your green card, so it is advisable to file for all 3 at the same time.

Follow Gabbi's advice. You don't want to be wasting time filing documents if the process takes longer than you thought. Right now it's no sweat of your back. If there's an emergency, you would be ready to go and as Gabbi stated, you can't work without one. Have them just in case. Prepare for the unforeseen.

Thank you for the answer Gabbi,

The reason I didn't want to file forms I-765 (for EAD) and form I-131 (for travel) is because one is $380 and the other one is $360..

But you are telling me that they waive the fees if you file for all 3 the same time..

I see you already applied for AOS.. can you tell me how that works because I am confusing..

You are saying that I won't have to pay the fees for EAD and TRAVEL AUTHORIZATION if I file them at the same time i file I-485?

Read the instructions for the forms. When the EAD and AP are filed together with, or while AOS is pending, the fee for them is waived. The fee is $1070.

There is an AOS thread in my signature.

The fees for I-131 and I-765 are waived when based on a I-485. You can file later for those, still for free if you like (you'd send proof of your pending I-485), but since it's free might as well file now. The GC usually takes 3-5 months to receive. It has been a long while since the process took two years. Please read the VJ guides and the form instructions - you will see the EAD and AP fees are waived.

The process is usually 3-6 months but there have been instances where it's taken much longer which is why it's best to file the EAD/AP. Their fee is waived so it doesn't hurt. Yes it's possible to apply for these later (and the fee would still be waived if you sent a copy of the AOS NOA1 with them) but it's best to apply at the same time because sometimes it can still take a while to get them and you don't wanna be caught without them if you need them.

Whether you can renew your licence with the AOS NOA1 depends on your state rules. Some states require the AOS approval notice, or EAD, or the GC itself.

yes, its unlikely that it will take two years, but it def could and has. Sometimes things just happen that way, and best to be prepared for the worst since there is little to nothing you can do to make USCIS speed up! lol :) good luck!

We did the same and didn't file the travel document. It took us 2 month to receive our EAD and 3 months for our AOS. Like everyone else says the fees are waived when filed with the AOS application. If you decide to file travel documents later you will have pay the fee.
