I received an email informing me about USCIS accepting my I-130 petition. They informed me that my petition have been routed to California and I will receive the hard copy Form I-797 in about 7 - 10 days by standard mail...

how do I apply for IR-1\CR-1 wish is more easier I think I don't still understand this think well pls someone holp me???

When you send the I-130....the immigrant petition, you will become an IR1/CR1 case. You have already begun the IR/CR visa process :thumbs: !!!!

the difference is that the first one is for spouses married over 2 years at the interview, the beneficiary will recieve the 10 year GC.

CR is conditional residence for spouses married under 2 years, they will have to remove conditions in order to receive the 10 year GC. If you have been married less than 2 years, you will get the 2 year GC and will have to remove conditons to get the 10 year GC.

Once the I-130 petition is approved, then you will be eligible to file for the IR1/CR1 (which one is dependent upon how long you've been married).

Oct 6, 2011: NVC process completed
Nov 4, 2011: Interview date assigned
Dec 2, 2011: Interview at Consulate (Result: AP - No reason given on 221g)
Feb 7, 2012: Passport requested by Consulate
(...Husband needed passport for personal reasons during this time...)
Apr 9, 2012: Passport mailed to Consulate
Apr 25, 2012: Visa issued
May 1, 2012: Visa in hand
May 31, 2012: POE at Montreal's Trudeau Airport
Early July: Physical Green Card received in mail. Yes, it's green!

March 13, 2014: ROC filed (went to VSC)

March 17, 2014: NOA

April 22, 2014: Biometrics appointment

December 9, 2014: Case inquiry initiated

December 11, 2014: Response: "The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required security checks remain pending."

March 14, 2014: Received NOA that approval had been given on March 10; expect new GC within 60 days.

when USCIS stated they accepted your form I-130 and routed it to CSC, what type of application/petition did you apply for? if the application was for a spouse then that is IR/CR petition and like previous posters said, your length of marriage will tell if it is now IR-1 (more than two years) or CR-1 (less than two years of marriage)

09/15/2012: Got Married
09/26/2012: Mailed I-130 from Nigeria( delayed by customs)
USCIS stage ( 66 days)
10/12/2012: NOA 1
12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).
01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK

The use of the word "you" to the in this context OP is incorrect, an approved I-130 petition will make the OP's spouse eligible to apply for a visa.

Once you file the I130 petition that is automatically applying for CR-1/IR-1. If he gets here in less then 2 years of the marriage then it is CR-1.(conditional relative). If he gets here after 2 years of the marriage then it is IR-1 (immediate relative). And he can start working right away.

That's not quite correct. The filing of an I-130 petition starts the process, only when the petition is approved is when the foreign citizen relative is able to apply for a visa.

your I-130 or the application for IR1/CR1 is now in california service center and when you receive the hard copy I-797 this is notice of action 1 aka NOA1.

i am in your position too. hoping you good luck in your immigration journey.

The I-130 form is not the same thing as an application for a CR-1 visa. The I-130 is the petition filed by the USC; the foreign spouse applies for a visa from the Embassy/Consulate after said petition has been approved utilizing the DS-230.
