If you entered on a K1 you may be able adjust status on your own (without your husband's involvement). This is something that you do not want to try and do without knowledgeable guidance. Somehow you need help with the process.

There are immigrant advocacy groups that can offer you free or low cost help.

Not that easy. Potentially possible but you should really consider consulting an attorney. Generally K-1 holders can only adjust through marriage to the original petitioner or VAWA - if you can prove he was abusive to you (cheating isn't abuse).

I am the USC, husband is adjusting from B2.

I am so sorry to hear about what you are going through. You seem like you're a very nice woman and you did the best that you could do to save your marriage even to the extent of forgiving his affairs. Anh map has provided you some good information. Good luck to you and stay strong.

Again, though, that isn't abuse.

That is not to say you definitely will not be able to get a green cars anyway - you might. We can't tell you for certain. Contacting an immigration attorney for a free consultation is really where you need to start to figure out exactly what options you have.

Based on your post there isn't abuse. Cheating isn't abuse.

Therefore the only change is AOS but a you're getting a divorce you can't do that. I do not believe Ahn Map's suggestion is valid but speak to an immigration attorney to find out for sure.

Your only choice is to leave and return to the Philippines.

You need a family law attorney (divorce) and a good immigration attorney ( learn about adjusting status on your own).

I will echo what the previous posters have said just for emphasis and tell you that your husband cheating or expressing his 'special' sexual preferences to you is not abuse. I'm sorry if you did not know you were going to be in an open marriage before you got here. Now is not the time to dwell on your husband's actions though. You need to focus on your sorting out your (status) situation, get a good immigration attorney and get a divorce.

The good thing is that most immigration attorneys offer a free initial consultation so you'll be able to compare advice and get a feel for who you would feel comfortable working with.

Good luck!
