I just watched the video of your fiances story. So very sad, and I hope that your visa is approved quickly for the both of you. Such a tragedy for that to happen to anyone, but for it to happen twice

to the same person and then so close together has got to be so very hard to deal with. Praying for you and your fiance and may god bless this journey you are on and may it turn out exactly

Thank you sis! And yes I so love my fiance and the boys. And my family are loving them too. I know how painful his life had been kaya I love him wholly and unconditionally. Kaya lalaban kami sis sa abot ng aming makakaya. I know GOD has a reason for everything. We still keep relying on HIM.

Hey Eugie, just saw the news article and the video. What happened was so tragic and now here comes this AP hole. It's a good thing though that he can spend time with you in the PI. I am sorry to hear your story and hope that it all works out for you. I can see why there might be some hesitation on the part of the embassy to approve the visa though. I read the article on your finace's accident. It was in Feb. 2010 and by Sept. 2010 he was engaged to you. Also as a taxpayer of this country, I have a problem with him getting disability. I am no doctor but, I can see his broken bones are healed, he has 2 arms and 2 legs, he can obviously pick up at least 50 pounds ( He has his son on his shoulders) and can lift his arms above his head. I am tired of paying taxes for people that collect taxpayers money when they can be employable. If he has a disability that is not apparent, I will apologize but from appearances it looks like someone taking advantage of the system.

Thank you pacificmeetwest. Yes, we will be getting married here and will go to spousal process. We have our lawyer to help us on this process. and oh, Your city is just a neighbor to mine. I live in Tangub City.

It's already 1 year since we filed the petition and waiting for 5 months since my interview and was put in AP and today I received an email from the embassy. This is what the email said:

This is in reply to your October 4, 2011 inquiry regarding your visa case.

The case is no longer under our jurisdiction. On September 20, 2011, we returned the I-129F visa petition to the U.S. Citizenship and Immigration Services (USCIS) office in Laguna Niguel, California through our National Visa Center (NVC) for appropriate disposition.

When USCIS is in receipt of the petition, you may wish to contact the USCIS National Customer Service Center at 1-800-375-5283 regarding this matter.

But they still have my passport, they haven't send it back to me yet. I'm just worried if they lost it since last month the embassy got flooded. Then Me and my fiance are going to get married here in the philippines. What are we going to do since we have K1 petition pending? Do we need to wait for the USCIS decision before filing for another petition? Although my fiance will be living here in the philippines for awhile, we just wanna prepare what we will do next when we will start of the spousal route. Any help will be so much appreciated.

If you have been already waiting for 5 months and they sent it back, That means that it has expired and when the USCIS receive it they will send you a letter saying that it has expired and that you have to reapply. They only allow K-1 visas to exist for one year. If they aren't approved by then they are sent back and the USCIS will let the petitioner know. I think you love each other anyway so get married and then file I-130. Good luck.

I am so sorry you are going through this. I thought I heard about that accident on the news here. Hopefully the two of you can get some good news soon.

Al and Patricia, I just wanted to say I have been in two car accidents in one day but nothing like what happened to the OP's fiance. I had no broken bones or anything and I did not spend any time in the hospital. For almost two years my back and neck hurt everyday along with headaches everyday. My job at the time required me to move 50 pound bags around daily and I was in a lot of pain at the time. Not long after that I found a new job where I did not have to lift as much. I just remember I could lift the 50 pound bags but I was in a lot of pain.

AOS Journey

11-04-2011 sent AOS to Chicago lockbox

11-07-2011 delivered

11-08-2011 Date on text messages but did not receive until 11-22-2011

11-23-2011 Check cashed.

11-25-2011 Hard copies of NOA1s

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!

I'm not a doctor, but I play one on Visajourney. In lieu of a physical exam, I'll take a look at a picture of you online. I didn't think it was necessary to open your medical file. In my professional opinion, the picture gives every indication that you are ready to go back to work. You can't apologize in advance for ####### like this, especially when it's completely off topic and unhelpful to the OP

Sorry to hear what happened to you guys.

I hope your attorney gives you good advice on the rest of your journey.

Although I've read a little bit about cases like yours, I'm not very familiar with what happens when a case gets sent back to the USCIS. I think the California Service Center tends to let them expire, and the Vermont Service Center tends to send you a Notice of Intention to Deny. If you get a Notice of Intention to Deny, it's my understanding that you should respond to it, otherwise, the reason for your denial will follow you to the spousal visa process. I'm not sure how a case should be handled which is allowed to expire at the USCIS.

Sorry to hear about your petition being sent back. Thats means the consulate denied it. You should find out the reason for the denial. CSC may let it expire, and they may send out a NOIR (notice of intent to revoke). Burden of proof is on US to prove a boni fide relationship, K1 CR1... Getting married means starting from scratch.

You may want to go to the consulate and ask about your passport. If your petition was returned to USCIS they should have returned it...
