Hello:)

I need help.......

I have a cousin who is special needs and her family cannot take care of her financially and physically. She is 30 years old but her mentality level is of a teenager. She lives in Mexico.

My questions are.....

How can she get a traveler's visa?

or what type of visa does she need to come over here?

I want her to come to the USA to visit because that is one of her dreams, but I do not know what she needs.

Note sentence #1 and sentence #2 don't agree.

If her family can't take care of her financially, how san she visit.

But putting that aside, she will have to apply for a tourist visa just like any other tourist who widh to visit the US. All criterias would apply to her too.

You are missing the point, a vistor visa application must show that they have reason to return to their home country, the poster has stated that the family can not take care of her finanically nor physically.

So where is the proof that the petitioner would return to their home country?

Contacting an advocacy group or charity involved with the type disability/condition may be helpful to learn about some type of program that may assist with securing some sort of visa.

The tourist visa may be difficult if it is perceived that it is for the purpose of coming to live in the US.

Sounds like she has MUCH bigger needs than a vacation.

If you intend funding the trip sounds like the money could be MUCH better spent.

I want her to come to the USA to visit because that is one of her dreams, but I do not know what she needs.

As others have mentioned, the odds of her getting a B2 visa for the purpose of visiting the US is slim. There are multiple factors that would indicate to a CO that she has no intention of leaving the US once she enters. She presumably is not employed and owns no property, so she has no financial ties to her home country. Her family in Mexico can't take of her, but she apparently has family in the US that can, so it appears that even staying illegally in the US would be better than staying in Mexico. One of the biggest advantages of having legal status in the US is that it allows an alien to work, but if she's unemployable then the point is moot. She has every reason to come to the US and no reason to return home.

What is the nature of her disability? Is there any sort of medical treatment she might benefit from, especially treatment that's available in the US and not available in Mexico? If so, it might be possible to get her a B2 to come to the US for medical treatment. You'll need a stack of statements from doctors confirming that she'd benefit from the treatment, that the treatment is available in the US, and there is a medical facility in the US that has agreed to treat her. You'll also need an affidavit of support and a statement confirming that you'll cover the cost of the treatment. A B2 issued for medical treatment would probably be good for only one six-month visit.
