Hey everyone! Hope you are well!! Bahadir and i have set November 19th as our wedding date. Our interview date is October 27th and he is going to fly here the day after he receives his Visa. We are guessing he will get his visa and be here by the 8th. FINGERSCROSSED....but do we have to wait a certain time before we can get a marriage license?

You have to look at your county for that. Either go there or look on the website/call them.

Every county/state has different requirements.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

We got our license right away but had to wait 24 hours to be able to marry after getting it.

Only used my passport and birth certificate didn't need ssn or anything else for Nebraska.

You don't have to wait to get the license (no need for SSN to get married) but there is probably a "cooling off period" between getting the marriage license and getting married. As stated, check with the county you will be getting married in.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

You can apply for marriage license as soon as he gets to the US, you just need both of your ID's (his passport for him). I see you're in Georgia and if you're planning to get married there, then you don't have to wait 3 days. There is no waiting period in the state of Georgia.

It's Victor from Russia writing. You don't have to wait 2 weeks and can marry as soon as allow laws of your state. But from main Russian fiance(ee)s forum I read a lot of advices to get SSN first. Some fiance(ee)s got problem with getting SSN after wedding, because they K-1 visa doesn't work after marriage, but they still haven't GC for a some months, so in many SSN offices clerks refusing to give SSN card after marriage and till getting Green Card by reason that your fiancee is legally in US, but "out of status" while AOS petition is pending (what can be long in some cases, especially if your fiancee will be choosed for "NameCheck"). So by opinion of Russian fiance(ee)s forum it's good decision - don't run to get marriage license right from POE, apply for SSN card first.

Yes we arent buying a plane ticket till we get the visa...we are prepared to buy a ticket the day of visa arriving...I understand if there is a delay with the visa part, i can accept this and we were just hoping there wouldnt not be any waiting on the getting marriage license side. Our wedding date is special date we chose so we are hoping to keep this date. But i understand your thoughts for sure about planning too much. Luckily we are having small intimate wedding. So the date can change, but due to not wanting to change the date we hope it goes smoothly. We have been waiting a year for this visa...we are ready to get through this part of the visa process!! Thank you everyone for the advice and fingers are definitely crossed!

Oh good point Victor! Can we apply for his green card right when he gets here anyway in the first few days he is here? We have waited a year in this visa process so chomping at bit alittle! :clock: :clock:

It's Victor again. Don't mix Green Card and SSN, please. :) You can apply for Green Card to USCIS only after marriage, it's I-485 petition. I told above about SSN card, for which it's better to apply before marriage in any local SSN office (you can find nearest to you here: https://s044a90.ssa.gov/apps6z/FOLO/fo001.jsp). But it's not "must have from the beginning" document for foreign fiance(ee), so if you sure that your fiance will not need SSN till getting Green Card/Employment Authorization, what can take a several months, you can marry as soon as you want. But then you, probably, will need to wait for a several months to be able to get SSN for your fiance. Though, I read that in some SSN offices they still can issue SSN even after marriage, but many people got refuse and instructions to wait till getting Green Card or Employment Authorization from USCIS to apply for SSN.

And yes, you can apply for SSN card even in the first day after arriving POE, so it will not delay wedding. :) You just need to print and fill application form and take documents with yourself to SSN office.
