Hi my wifes 1040 states she is single as we didn't get married till this year January 2011

Is this OK?

USCIS: I-130 CSC

03/18/2011 - Mailed I-130

03/21/2011 - I-130 signed for at Chicago Lockbox

03/24/2011 - NOA1 California Service Center

03/29/2011 - NOA1 hard copy received

06/29/2011 - NOA2 Received

07/05/2011- NOA2 hard copy received

Your I-130 was approved in 97 days from your NOA1 date.

I have the same problem as your wife. I hope it will not be a problem, IF this will be a problem. I will just write a letter that I will file a amended joint for my IRS 2010 this year once she become a legal resident and have a Social Security Number... I believe you have 3 years to amend your tax return.

As far as the IRS is concerned, whatever your marital status is on December 31st of that tax year is what your status is for the whole year. So, if you were single on Dec 31, 2010, you would file as single for the whole year.

In that example, you can't amend for 2010 because you were not married for that tax year.

You are all good - the status as on 12/31 of the the year is the control.

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

OP: As others have said, if you were single on 12/31/2010, then you would file single for that year.

I had some of the same misgivings, however, I was able to file for the 2010 tax year prior to getting married so there would be no question or ambiguity.

February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)

I filed single after I got married. It was easier and I had no problems whatsoever.

You could have a problem with the IRS. The correct filing is "married filing separately" in your case if you were married in 2010 and did not want to do a joint tax return. But that's another topic,
