Hi, my spouse and I are not living together currently. He is aware of my current address, and I still visit his address of residency. The AOS interview is in 27 days, so we should have enough time to sort this out. We've lived together for 5 years in his current address, but I moved out at the end of 2010.

My current driver's license address is not the same as his address. However, I have a previous driver's license that has not expired yet to his address, and we have proof that we lived in the same address. Will the USCIS know that I have another driver's license if I show them my old, but unexpired, driver's license?

You are suppose to let them know if you change address. Anything outside of telling the truth will be perjury. And yes, all any government office has to do is put your name in a computer and it will give back a plethora of information.

You had better think very carefully before you proceed to lie about your situation.

I forgot to mention that I'm the USC.

Renewing a driver's license takes months in California... I am not sure how I could explain the address in my license during the interview... As far as I know, couples are allowed to live in separate addresses, and my address is closer to work. Can I change the address using the USCIS site? Thanks in advance

You did not give a reason why you are not living together. Why did you move out? We're not mind readers here. :whistle:

Were you separated at the time when you sent in your AOS?

I would give the USCIS the new drivers license if they ask for it. Try not to hide anything from them, that will do you no good.

My wife(US Citizen) lives at home for only 4 days off the week, but that's due to having to travel 150 miles away for work. We stated that when I AOS.

So you're actually separated (i.e. not a "couple" anymore), not just physically separated. 15 miles is nothing so be prepared to explain why they should approve a visa for a couple that might be married but aren't "together". I'm not sure what USCIS will think but yes they WILL know you have the other licence and they will know you don't currently live together so don't try and lie about it. Be honest, it's your best chance.

I will change the address as soon as I talk to him about it. I have searched around the web about our scenario and this doesn't automatically equal a denial, there only needs to be a good reason why we're not living together. There are some couples that must live separately because of work or school. Also, I'm not in good terms with his parents as before (they live in that address too), but I still want to work it out with him.

They're not going to buy that it was necessary for you to move 15 miles away just so you could be closer to work. You would either commute the extra 15 miles, or your spouse would move with you. Married couples don't live apart from each other just to save less than 1/2 an hour in their daily commute. They going to assume your marriage is on the rocks, and that's why you've separated.

You're not bound by the terms of the I-864 yet, so the change of address requirement isn't going to be enforced. However, if the AOS is approved then the I-864 requirements become enforceable. Any sponsor who signs an I-864 is required to notify USCIS of their new address if they move.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

They're not going to buy that it was necessary for you to move 15 miles away just so you could be closer to work. You would either commute the extra 15 miles, or your spouse would move with you. Married couples don't live apart from each other just to save less than 1/2 an hour in their daily commute. They going to assume your marriage is on the rocks, and that's why you've separated.

If you claim you live together then they want evidence of that. If you claim you don't live together then they also want evidence of that, as well as a darn good reason for why you don't live together. Your situation falls into the category of "sh*t happens", but USCIS is a bureaucratic machine, and bureaucratic machines don't accommodate non-conformity. About the only thing you can do is tell them the truth and hope they accept it. My guess is that they probably won't.

I'm confused here. You say you left cause of his parents, as a couple have been the same for the past 5 years and he's sweeter than before.....Your asking should he change his address...Why isn't he living with you at your house full stop?

There's things missing here and you have to be upfront with the facts.

You have less than a month to sort out things properly and that isn't a long time. You need to talk to your husband now to get this sorted out or your interview may very well go t!ts up.
